Facts:
Following the running of race 7,ITM / GIB, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Mrs Thornton permitted her mount MAJOR TOM to shift outwards passing the 150 metres when not sufficiently clear of RECAYENNE which was dictated outwards then being checked near the 50 metres.
Mrs Thornton acknowledged that she understood the Rule and confirmed her admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Oatham used the available video footage to demonstrate the incident. He identified that passing the 150 metres MAJOR TOM laid out and this dictated REDCAYENNE outwards for 100 metres. He said the final check occurred near the 50 metres when MASTERCARD shifted in and contributed to the interference that REDCAYENNE received.
Mrs Thornton acknowledged that Mr Oatham’s interpretation of the incident was correct and she had nothing to add.
Submissions for Penalty:
Mr Williamson produced Mrs Thornton’s record which showed 1 previous breach under this Rule in the last 12 months. He said that Mrs Thornton’s actions cost REDCAYENNE a chance from finishing in 3rd place when MAJOR TOM shifted out abruptly at the 100 metres. He said that MASTERCARD contributed to the incident when that runner shifted in near the 50 metres and the Stewards were not attributing all the blame on Mrs Thornton. He said that Mrs Thornton had a very good record for a busy rider and described the level of carelessness as near mid-range. He said a term of suspension would be an appropriate penalty.
Mrs Thornton advised that she had engagements on 29 July and sought a 7 day deferment to her proposed suspension. Mrs Thornton advised that she does not ride in the South Island.
Mr Oatham advised that Mrs Thornton had no recent history of riding in the Central Districts on Industry days. Mrs Thornton accepted this fact.

The Committee carefully considered all the evidence and submissions presented. The Penalty Guide for Judicial Committees recommends that the starting point for careless riding is a 5 day suspension.
There were no aggravating factors.
The mitigating factors were Mrs Thornton’s admission of the breach and her very good record. In view of that, we applied a 1 day reduction.
We note that the protest that was filed against MAJOR TOM was dismissed.
The Committee deemed Mrs Thornton’s carelessness to be mid – range which was a neutral factor.
After taking into account all the above factors the Committee considered an appropriate suspension was 4 days.
