As Mr Elliot admitted the breach the Committee found the charge proved.
Penalty:
The Committee grants Mr Elliot a deferment to his suspension as per Rule 1106(2).
Accordingly, Mr Elliot had his license to ride in races suspended for a period to commence after racing on 29 July and conclude after racing on 10 August 2017 (5 days).
That period of suspension encompasses meetings at

Facts:
Following the running of race 2, Fell Engineering, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Mr Elliot allowed his mount YULANIA to shift inwards when not sufficiently clear of SHEZAROCKSTAR which was checked and forced inwards crowding FLORENCE IVY onto MIACOCCA near the 1100 metres.
Mr Elliot acknowledged that he understood the Rule and confirmed his admission of the breach. Mr N Harris assisted Mr Elliot at the hearing.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Oatham demonstrated the incident using the available video footage. He identified that near the 1100 metres Mr Elliot allowed his mount to shift in and into the line of SHEZAROCKSTAR when only ¾ of a length to 1 length clear of that runner. He said as a result of Mr Elliot’s carelessness 3 runners to his inside were crowded and checked with all their riders having to take a hold of their mounts. He stated that all 3 horses lost ground and added that several others runners that were following them were hampered and had to steady.
Mr Elliot had no questions of Mr Oatham’s interpretation of the incident.
Mr Elliot said that he initially jumped clear of SHEZAROCKSTAR and he was of the view that Mr Hills “dug up” his mount who was racing on his inside.
Mr Harris said that Mr Elliot thought he was clear of SHEZAROCKSTAR when allowing his mount to shift inwards.
In response to a questions from the Committee, Mr Elliot acknowledged that he was not the required distance clear of SHEZAROCKSTAR when allowing his mount to shift in and he accepted that Mr Hills was entitled to his rightful line of running.
Submissions for Penalty:
Mr Williamson produced Mr Elliot’s record which showed 2 previous breach under this Rule in the last 12 months. He said it was a reasonably good record for a busy rider (534 rides to date this season) and described the level of carelessness as low to mid-range. He submitted a suspension in line with that should be imposed.
Mr Elliot advised that he had engagements at Otaki on 29 July and sought a 7 day deferment to fulfil those engagements. He advised that he had not ridden recently in the South Island due to a lengthy suspension.
Mr Oatham produced Mr Elliot’s recent riding history which confirmed that he has ridden regularly in the Central Districts on Industry days. He advised that Mr Elliot last rode at Christchurch on 19 May this year. He said that he had no objection to the 9th of August being included in Mr Elliot’s proposed suspension given the status of the race meeting. He also advised that Mr Elliot rode at the corresponding meeting last year.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. The Penalty Guide for Judicial Committees recommends that the starting point is a 5 day suspension.
The Committee reviewed the video footage of the incident and determined that the level of carelessness was in the low to mid – range. This was deemed to be a neutral factor.
The aggravating fact was the consequential effects of Mr Elliot’s carelessness which resulted in 3 horses being crowded and checked to various degrees. We observed that SUN GENES was also crowded and had to steady along with DORINGTON PARK who was also hampered near the 1100 metres as a consequence of Mr Elliot’s inward shift. Accordingly, we applied a 1 day uplift.
The mitigating factors were Mr Elliot’s admission of the breach and his good record for which we applied a 1 day reduction.
On this occasion the Committee was satisfied that August 9 could be included in Mr Elliot’s suspension. We based this on the fact that the meeting is classified as a Feature day and not an Industry day and historically the Rogerson stable have attended Grand National week in Christchurch.
After taking into account all the above factors the Committee considered an appropriate suspension was 5 days.
