After taking all the above into account and the reasons given we find the charge proved.

Penalty:

Miss Collett's license to ride in races is suspended after racing today, 22 August and concludes after 30 August (4 days).

Facts:

Following race 5, an information was filed pursuant to rule 638 (1) (d).  Mr Williamson alleged that Miss Collett permitted her mount PAUHATU to shift inwards near the winning post on the first occasion when not sufficiently clear forcing THE PALM KING into the line of COUNT ON which was checked.

Submissions for Decision:

Mr Oatham demonstated the video films and pointed out to the committee PAUHATU ridden by Miss N Collett, racing in a 4 wide position approaching the turn out of the straight on the first occasion. On her inside, in a 3 wide position was THE PALM KING (Mr V Colgan) and on his inside, one length back in a 2 wide position was COUNT ON ( Mrs T Thornton). Mr Oatham then pointed out Miss Collett allowing her mount to move in on the point of the turn and into the line of THE PALM KING when only a neck clear of that runner. This movement caused Mr Colgan to ease his mount inwards and into the line of COUNT ON when a bare length clear. Mr Oatham said this caused Mrs Thornton to take a strong hold of her mount losing ground in the process.  He concluded by saying Miss Collett had not left enough room for the 3 runners on her inside, room which they were entitled to.

Mrs Thornton, rider of COUNT ON, was then called to give evidence. She confirmed she did receive pressure from Mr Colgan on her outside who she said, was a bare length clear of her when he moved in. Mrs Thornton said she had to take a hold of her mount and said she was entitled to be where she was at the time.

Mr Colgan, rider of THE PALM KING, said that Miss Collett had come across into his line but not sharply. He confirmed that he had to move in to avoid the heels of PAUHATU as he was only 3 quarters of a length behind him. Mr Colgan said he was unable to relieve the pressure on Mrs Thornton because of the inward movement of PAUHATU.

Miss Collett, in denying the breach said, she had received pressure from Mr Parish on her outside, which caused her to move in. She also said she believed Mrs Thornton overreacted before the incident by taking a hold as her mount was over racing.

Mr Williamson, in summing up said both witnesses confirmed they had received pressure from the outside. He submitted that Miss Collett had come in from a 4 wide position to one of 3 wide and did not leave enough room for the 3 runners on her inside. He said she was not  the required distance clear of Mr Colgan.

Reasons for Decision:

The committee has carefully considered all evidence and submissions and reviewed the video films. It is clearly evident that Miss Collett has moved in from a 4 wide position to one of 3 wide going into the point of the turn.

The committee is satisfied that, Miss Collett was only a neck or so clear of Mr Colgan when moving in. This inward movement caused Mr Colgan to move into a 2 wide position and into the line of COUNT ON, which receieved a sharp check.

We considered Miss Collett's submission that Mr Parish had dictated her in, a submission we do not accept.  There was always a considerable  gap between their 2 mounts and Mr Parish was clearly behind Miss Collett at the time, making it impossible for him to dictate her in.

The committee is satisfied Miss Collett was not the required distance clear of Mr Colgan when moving in.

Submissions for Penalty:

Mr Williamson produced Miss Collett's record which showed only 1 suspension in the last 12 months.  He submitted today's breach was in the low to mid range. 

Miss Collett told the committee she had no immediate commitments and wished to start a suspension following today's racing.  She said she only rode in the North Island at present.

Reasons for Penalty:

The committee considered all evidence and submissions.  Mitigating factors in this charge are, Miss Collett's very good record, the fact that the interference occurred on the point of the turn when distances are more difficult to judge plus, the slight overracing of COUNT ON at the time of interference.  However, as described above, Miss Collett was certainly not the required distance clear when moving in.  Taking all these facts into account we find the breach to be at the low end of carelessness.
