Following Race 10 a protest was lodged under Rule 876(1), by the Informant Mr A Coles, alleging that ARCTIC ICE placed second by the judge interfered with the chances of HUMDINGER placed fourth by the judge.

Following Race 10 a protest was lodged under Rule 876(1), by the Informant Mr A Coles, alleging that ARCTIC ICE placed second by the judge interfered with the chances of HUMDINGER placed fourth by the judge. The margin between 3rd and 4th was a neck.

All connections were informed of the protest and all parties present were asked to introduce themselves,

--

Rider, Mr M Walker, represented the connections of HUMDINGER, and Mr Lammas, rider of ARCTIC ICE and trainer, Ms M Murdoch were present.

--

Mr J Oatham demonstrated all relevant video films and pointed out Mr Lammas moving out into the line of DELI COAST, ridden by K Hercock, which in turn moved out into the line of HUMDINGER, ridden by M Walker, Mr Oatham said the interference was just short of the 50 metre and that Mr Lammas had moved approximately 2-3 horse widths. He also said Mr Walker's mount was running on strongly at the time and lost some momentum.

Mr Walker, rider of HUMDINGER, said that prior to the interference he was going to run a good third but his momentum was stopped for 3-4 strides. He said he was pushed out 3-4 horse widths.

Ms Murdoch, trainer of ARCTIC ICE said she believed Kate Hercock moved out contributing to the interference to Mr Walker.

Mr Lammas, rider of ARCTIC ICE, admitted coming out but said he believed Kate Hercock's mount DELI COAST had over-reacted and moved further out onto Mr Walker on its own accord.

Kate Hercock, rider of DELI COAST, was then called in to the room and upon questioning from the Chairman, said she had kept a straight line at all times.

Mr Coles in his final submission said it was clear from the film that HUMDINGER had lost considerable momentum through the interference and also asked the committee to take note that at the time of the interference HUMDINGER was ahead of the third placed horse KEYNAISSUE.

Decision:

--

The Committee was clearly of the opinion that interference did take place approximately 50 metres from the finish when ARCTIC ICE moved out approximately 3-4 horse widths and into the line of DELI COAST. He was not the required distance clear. DELI COAST was then in turn pushed out into the line of HUMDINGER who lost considerable momentum as a result. HUMDINGER then finished on strongly to be only a neck away from the third horse KEYNAISSUE.

The second question we must ask ourselves is whether as a result of this interference, were the chances of HUMDINGER finishing in a better place affected. The Committee is clearly of the opinion that HUMDINGER's chances of finishing in a better place were affected by the ground and momentum he lost.

In applying our discretion we uphold the protest because ?

  1. The margin between third and fourth was only a neck and the interference suffered by HUMDINGER cost him considerably more than that by losing so much momentum.

  3. HUMDINGER was ahead of the third horse when suffering the interference.
  4. --
  5. The strong manner in which HUMDINGER finished the race from the 50 metre mark where the interference occurred.
