As Mr Arumugan admitted the breach the charge was found to be proved.

Penalty:

Accordingly after taking all the above factors into account we impose a fine of $200.00.

Charge:

Following race 10 an information was lodged alleging a breach of rule 610 (4) in that Mr Arumugan had in his possession a modified body protector.

Facts:

Mr Coles told the committee that at the Tauranga races on 25 June 2011 a number of riders had been spoken to and warned that the stewards would be checking for compliance of safety vests.

A check of all riders’ vests was done today and Mr Arumugan’s vest, which was an approved type, was found to have the tail section of pads removed and modified with non regulation pads.

Mr Arumugan said he was not aware the body protector he had borrowed from Miss Taylor had been modified.

Mrs Logan explained to Mr Arumugan it was like driving a car you must have a current warrant of fitness. She reminded Mr Arumugan that the body protector is designed to protect their spine.

Submissions for Penalty:

Mr Coles submitted that Mr Arumugan did ride in a modified body protector which is a clear breach of the rules. Mr Arumugan had no previous breaches of the rule. Mr Coles’submission was for a fine of $200.00 which was imposed in a body protector incident at Egmont Racing Club yesterday.

Mr Arumugan had nothing to say.

Reasons for Penalty:

The committee carefully considered all the evidence and submissions as presented. We also had the opportunity to inspect the vest and the modifications made to it.

Mitigating factors are Mr Arumugan’s admission of the breach, no previous breaches of the rule. The rest of his vest was found to be in very good condition.

The aggravating factor is Mr Arumugan rode in a modified body protector which automatically made the vest non- compliant which is an obvious safety issue.
