Facts:
Following the running of the ITM/GIB WHANGAREI GOLD CUP, an Information was lodged by Senior Stipendiary Steward, Mr M Williamson against Licensed Trainer, Ms K Knight alleging that Ms Knight had presented an incorrect horse for the Race.
Rule 404(2) provides: a person shall not enter , accept , start or intend to start a horse in a Race or trial ( including a jump-out or test for certification purposes ) under a name other than its registered name or its recorded breeding details in the case of an unnamed horse that is entered for or starts in a trial.
Ms Knight was present at the hearing and she advised the Committee that she admitted the breach.
Mr Williamson said that Stipendiary Steward, Mr W Robinson was checking the horses out for Race 4. Ms Knight presented her horse for checking and Mr Robinson noticed that the gear on the horse was incorrect. He then checked the brand and found that the horse being presented was in fact the horse she had entered for Race 5 and not ITELLYOUONETHING which was correctly entered for Race 4. Due to Mr Robinson's intervention the mistake was rectified and the correct horse did race.
Ms Knight for her part said that she had read the Racebook incorrectly and she didn't check properly. She said it was a complete mistake on her part .
Submissions for Penalty:
Mr Williamson said that he could only find 3 previous cases under this Rule and based on those he submitted that a fine of $500 was appropriate.
Ms Knight accepted that she would be fined and said she would learn from the experience and wouldn't make the same mistake again.
Reasons for Penalty:
This is a clear mistake on Ms Knight's part. It was explained to her that it could have been worse if it had not been picked up by Mr Robinson. She was told that if the horse had have started and won or run a place then it would have been disqualified.
The JCA Penalty Schedule shows 11 previous breaches of this Rule but these include Trials as well as Races. The majority of fines are $500and therefore to be consistent the Committee will impose a fine of that amount on Ms Knight.
