Decision:

The Committee finds the charge proved.

Penalty:

The Committee therefore imposes a suspension of Miss Spratt's licence to ride from after the conclusion of racing on the 26th of December 2017 until after the conclusion of racing on the 31st of December 2017.

Facts:

Following the running of the last Race of the day an Information arising out of Race 2 the NORTHLAND WASTE, was lodged by Stipendiary Steward, Mr A Coles against Class A Jockey Miss S Spratt alleging that Miss Spratt when riding O'SAM allowed her mount to shift out near the 350 metres mark when not sufficiently  clear of WINNIE'S RAINBOW which was checked.

Rule 638(1)(d) provides : A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Miss Spratt was present at the Hearing and she advised the Committee that she did not admit the breach.

Senior Stipendiary Steward, Mr M Williamson demonstrated the incident by use of the race films. The quality of those films was not perfect and there were 3 views on a split screen.

He showed where O'SAM was in a loose position adjacent to the rail and WINNIE'S RAINBOW was in a loose one off position but back from O'SAM. At about the 450 metres mark he said that O'SAM was about one and a quarter lengths in front of WINNIE'S RAINBOW and that horse improved to about three quarters of a length on the outside of O'SAM. He said that on the turn Miss Spratt moved her horse out when not sufficiently clear and this caused Mr Innes on WINNIE'S RAINBOW to have to check his horse . He said that Miss Spratt moved out at least 2 horse widths and as a result Mr Innes's horse lost approximately one and a half lengths.

He advised that O'SAM finished second and WINNIE'S RAINBOW fourth.

Miss Spratt in cross examination asked Mr Williamson if Mr Innes had room outside him to move and the answer was no. She then asked if at the time she moved out did he have room on his outside and the answer was yes.

Mr Innes as the rider of WINNIE'S RAINBOW then gave evidence and said he was looking for a run inside the 400 metres. He said he was moving forward and Miss Spratt moved out inside him and he had to check his horse. He said Miss Spratt came out gradually but he had to check and that cost him from finishing closer. He said that as a result of the check he lost quite a lot of ground but he was unsure as to how much. He said that if he stayed where he was then it would have been worse and he restrained his horse. He said he did not have pressure from the outside.

In answer to a question from the Committee he said that he thought Miss Spratt was just under 2 lengths clear of his horse. He also told the Committee that he did not call out to Miss Spratt even though he was moving forward and he could see what was happening.

Miss Spratt then cross examined Mr Innes and asked if he expected her horse to move out . In answer he said that he could see what was happening.

Miss Spratt then gave evidence and said she was moving out to be behind ONE BAKERSTREET which had moved to the lead. She said that she was not in Mr Innes's running line and that she had moved out well before he checked his horse. She also said that if his horse was travelling as well as he said then he would have moved up and held her in.

She said that Mr Innes was being wary and his checking of his horse was not as a result of her movement. She believed she had room and she moved out gradually.

Submissions for Decision:

In summing up Mr Coles said that Mr Innes was making ground on the outside of Miss Spratt and she was only three quarters of a length clear when she came out. He said she was never sufficiently clear when she came out and that the movement cost WINNIE'S RAINBOW a length.

Miss Spratt said that when Mr Innes checked his horse she was not in his running line. She also said that Mr Innes' horse was not travelling well and that he opted to restrain his horse rather than she checking it.

Reasons for Decision:

The Committee listened intently to the evidence presented and viewed the films several times. The requirement is that before moving out a horse must be its own length and one further length clear of the horse on its outside (or inside).

In the Committee's view Miss Spratt was about three quarters of a length clear and therefore did cause interference to WINNIE'S RAINBOW and caused that horse to be checked.

Submissions for Penalty:

Mr Coles in his penalty submissions referred to Miss Spratt's record which included 4 suspensions in the last 12 months. He said that the incident was at the low end and he also said that Miss Spratt was entitled to defend the charge.

Miss Spratt referred to her summary above which the Committee should take into account.

She asked for a deferment of any suspension until after the Ellerslie meeting on the 26th of December 2017.

Reasons for Penalty:

In assessing penalty the Committee is of the view that this matter is at the very low end of seriousness. We believe that the chances of Mr Innes's horse were not affected and we also believe that Miss Spratt was not helped by Mr Innes not calling out when as he told us "he could see what was happening".

Her record is fair particularly in view of recent suspensions but however she is a busy Rider.

We have adopted 6 National days as a starting point penalty and we note that as a result of the deferment of penalty the 6th day would fall on January the first which is an iconic raceday. We don't believe that the incident being very low level would  warrant Miss Spratt missing an iconic Raceday and therefore we believe that a suspension of 5 National Riding days is appropriate.

We have agreed to a deferment of suspension pursuant to Rule 1106(2) until after the conclusion of racing on the 26th of December 2017.
