Facts:
Following the running of race 7, A’Fare Catering, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Ms Johnson permitted her mount CHASING GREAT to shift outwards when not sufficiently clear of ROCANIC which was checked near the 800 metres.
Ms Johnson acknowledged that she understood the Rule and confirmed her admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Oatham used the available video footage to demonstrate the incident. He identified that passing the 900 metres Ms Johnson was racing in 3rd position adjacent to the running rail. He said that shortly after that point Ms Johnson permitted her mount to shift out to a 3 wide position when no more than ½ a length clear of ROCANIC. He said this resulted in that runner receiving a reasonably severe check and added that Ms Johnson was never clear to shift ground.
Ms Johnson said that when she was improving her position she didn’t realise that Ms Collett had improved to be racing outside ROCANIC. Ms Johnson said that she misjudged the manoeuvre.
Submissions for Penalty:
Mr Williamson produced Ms Johnson’s record which showed 1 previous breach under this Rule in the last 12 months. He said the carelessness was at least mid-range and a suspension of not less than 5 days would be appropriate.
Ms Johnson advised that she had engagements at Te Rapa on 19 August and any proposed suspension could start after that date. Ms Johnson said that she had ridden all over the North Island in the last 12 months when she was attempting to win the Jockey’s premiership. Ms Johnson acknowledged that she has no history of riding in the South Island apart from Riccarton in November.
Mr Oatham confirmed that earlier in the year Ms Johnson rode in the Central Districts on a regular basis and had no objection to those dates being included in her suspension.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. The Penalty Guide for Judicial Committees recommends that the starting point for careless riding is a 5 day suspension.
It was obvious on the video footage that Ms Johnson permitted her mount to shift outwards near the 800 metres when only ½ a length clear of ROCANIC. This resulted in that runner receiving a relatively severe check and losing at least 2 lengths. The Committee deemed the level of carelessness to be just above mid-range and an aggravating factor which warranted a 1 day uplift.
The mitigating factors were Ms Johnson’s admission of the breach, albeit it was inevitable given the compelling video evidence and her very good record. For these factors a 1 day reduction was applied.
After taking into account all the above factors the Committee considered an appropriate suspension was 5 days.
