Decision:

The committee was not satisfied that RIVA BALLERINA was denied a fair start due to mechanical failure of the starting stalls and therefore declared it to be a starter.

Facts:

Following race 5, an information was filed pursuant to Rule 632. The informant, Mr Sweeney requested a ruling as to whether the gate of RIVA BALLERINA was slow to open.

Submissions for Decision:

Mr Williamson demonstrated the incident by using the available films. He pointed out to the committee that the barrier of RIVA BALLERINA was slow to open by approximately half a length. He asked the committee to make a ruling as to whether the horse’s chances were materially prejudiced.

Mr Sweeney who represented the connections advised the committee that in his view RIVA BALLERINA's chances were not affected and didn't think he would have finished in a dividend bearing place. However, he confirmed the gate was approximately half a length slow to open and was seeking a ruling.

In response to a question from the committee Mr Sweeney confirmed that the gate opened by itself and he did not have to force it open.

Mr Harrison said the film showed that RIVA BALLERINA's gate was slow to open by half a length. In his view this was caused by the strong wind and not through mechanical failure of the starting stalls.

Reasons for Decision:

The committee carefully considered all the evidence submitted and reviewed the video films several times. While we concede the gate was slow to open by approximately half a length, we are of the view the high winds caused the incident and we do not believe that RIVA BALLERINA was denied a fair start. Further the committee rules that the chances of RIVA BALLERINA were not materially prejudiced, noting the horse finished in 7th placing 6.8 lengths from the winner.
