Accordingly, the Committee disqualified KEENTORULE from 4th place.

The amended placings are:

1st No 9 BEAUTY BEAST

2nd No 2 HUMAN TORCH

3rd No 6 ZEST PRINCESS

4th No 13 FAIRY STORY

In conclusion it was ordered that stakes and dividends be paid in accordance with the amended placings.

Facts:

Following the running of Race 4, More FM Northland Saturday Sports Desk, an information was filed pursuant to Rule 648(3). The Informant, Mr Oatham lodged a “Request for a Ruling” alleging that Apprentice Rider Miss Wenn weighed in at 1kg under the required weight for KEENTORULE which accordingly should be disqualified.

Miss Wenn acknowledged she understood the Rule and the nature of the charge.

Miss Wenn admitted the breach and was assisted at the hearing by Mr A Peard.

Rule 648(3) provides: “If, on being weighed in, a Rider cannot draw the proper weight (meaning thereby the weight allotted by the Handicapper for his horse to carry and adjusted only by any re-handicap, by having been declared overweight, by penalty or by authorised allowance) the Clerk of the Scales shall allow such rider 0.5 kg and if the allowance is not sufficient to enable the proper weight to be drawn then subject to sub-Rule (4) of this Rule then in addition to any other penalty which may be imposed the horse shall be disqualified for the Race.”

Submissions for Decision:

Mr Oatham informed the Committee that the Clerk of Scales, Mr Stewart had advised him of a weight discrepancy involving the horse KEENTORULE.

Mr Oatham informed the Committee that KEENTORULE carded weight was 58.5kg and received a 4kg allowance, reducing the weight to 54.5kg. He said the 1kg permitted for her body protector raised the weight to 55.5kg. He stated Miss Wenn on returning to the scales after the Race weighed in at 54.4kg, which meant she was 1.1 kg underweight.

Mr Oatham submitted it was mandatory that KEENTORULE be disqualified from the Race.

Miss T Wenn confirmed that she did weigh in 1.1 kg light and was unable to offer an explanation.

Mr Peard submitted he accepted the evidence presented and had no objection to KEENTORULE being disqualified from the Race.

Reasons for Decision:

The Committee carefully considered all the evidence and submissions presented. The evidence was very clear and not disputed that Miss T Wenn did weigh in 1.1 kg underweight. The relevant Rule provides for a tolerance of 0.5kg and in this case Miss T Wenn weighed in outside the permitted 0.5kg leeway therefore the Committee must disqualify KEENTORULE from 4th place.
