As Ms Collett admitted the breach the Committee find the charge proved.

Penalty:

Accordingly, Ms Collett had her license to ride in races suspended for a period to commence after racing on 13 September and conclude after racing on 18 September 2015 (3 North Island days).

Facts:

Following the running of race 6, TAVISTOCK NORTHLAND BREEDERS STAKES, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Williamson, alleged that Ms Collett rode SELFIE carelessly when shifting ground outward from inside the last 375 metres making contact with ROCANTO(D Johnson) causing interference for a distance.

Ms Collett acknowledged that she understood the nature of the charge, the Rule and confirmed her admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Coles identified on the video footage that near the 375 metres Ms Collett attempted to obtain a run on the inside of ROCANTO. He said in doing so her mount SELFIE made contact ROCANTO for 5 to 6 strides. He said in mitigation there is some contribution from other horses in the latter part of the incident. He identified that SELFIE shifted away from THE JUSTICE LEAGUE and DEL CIELO moved in when ROCANTO made contact with that horse. He added that Ms Johnson was entitled to hold her line.

Ms Collett said in mitigation the riding was very competitive and ROCANTO did move in when Ms Johnson buffeted her mount. She acknowledged that contact did occur and she may have taken the competitiveness too far. She described the movement as minor.

Submissions for Penalty:

Mr Williamson produced Ms Collett’s record which showed 1 previous breach under this Rule in the last 12 months which incurred a 4 day suspension. He said this is an excellent record and noted Mr Coles' interpretation of the incident is excellent. He stated Ms Collett may have over stepped competitive riding which resulted in ROCANTO being interfered with. He assessed the overall incident was low to mid - range and submitted an appropriate suspension would be at the low end.

Ms Collett submitted that she has an excellent record. She believed the interference is low end and asked the Committee to take into account her admission of the breach.

Ms Collett advised that she had no upcoming engagements and any proposed suspension could start immediately. She told the Committee that she has a recent history on riding all over the North Island.

Mr Williamson confirmed that Ms Collett has ridden recently in the Central Districts on Industry days.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. The Committee have adopted 5 riding days as the starting point in considering the term of suspension for this careless riding charge. The mitigating factors are Ms Collett’s admission of the breach, the level of carelessness is low end because of the contribution from other horses as identified by Mr Coles and her very good record in relation to this Rule for which she has been given credit for. However, this has to be balanced against the consequences of Ms Collett’s actions which resulted in ROCANTO being buffeted. We note that there were some contributing factors involved in the incident when Ms Johnson tried to hold her line by turning ROCANTO’S head inwards.

The Committee considered that the carelessness occurred in a Listed race worth $50,000. However, given the circumstances Ms Collett is not penalised for this fact.

The Committee is satisfied that Ms Collett has a recent history of riding in the Central Districts on an Industry day.

After taking into account all the above and placing emphasis on the mitigating factors the Committee considers an appropriate suspension is 3 days.
