Following race 7 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendary Steward Mr A Coles that N Collett committed a breach of that rule in that near the 250m ADORN (N Collett) shifted in when not clear of VIVALDI’S DREAM (D Leung) causing that horse to be checked.

Miss Collett was represented by Ms D Logan.
--At the start of the hearing Miss Collett said that she wished to change her plea in that she now admitted the charge. This request was allowed.

As Miss Collett had changed her plea the Committee was now required to adjudicate on penalty only.

Mr Oatham showed the offence on the video films. Soon after entering the final straight Mr Leung could be seen on his mount with a rails run. Miss Collett was on Mr Leung’s outer and a little forward of him. As she rode her mount forward she moved in 1 horse width, taking Mr Leung’s line. Miss Collett was, at the most, only 1 length ahead of Mr Leung.

Miss Collett said that it was raining at the time and she was not aware of Mr Leung being on her inside. She said that he had called to her as he was checked and she had moved out immediately.

In his submissions on penalty Mr Cole said that considering the extensive riding that Miss Collett did he considered her record of 2 suspensions in her career was a very good record. He considered the offence was at the lower end of the scale and asked for a 4 day suspension.

Miss Collett gave notice of her engagements for 16 July.
