As the breach was admitted we find the charge proved.

Penalty:

After taking all the above into account we determine a 4 day suspension is appropriate.  Accordingly we suspend Mr Hutton's riding license from after the conclusion of racing on 16 July until after racing on 23 July 2015 (4 North Island days).

These days include Avondale 17 July, Te Rapa 18 July, Matamata 22 July and Awapuni 23 July.

Facts:

Following race 5, the NZB Insurance Pearl Series Race 1600, an information was filed pursuant to rule 638 (1) (d).  The informant alleged that Mr B Hutton, rider of SUMMER'S DAY, allowed his mount to shift out over the final 100 metres when not clear of FIAMETTE causing interference.

Rule 638 (1) (d) says a rider shall not ride a horse in a manner which the judicial committee considers to be careless.

Mr Robinson demonstrated the video films pointing out the ride of Mr Hutton in the run up the home straight.  He said it was unlikely there would have been a charge against Mr Hutton if the protest concerning his ride had not been upheld resulting in a change of placings.  He pointed out the first 2 bumps were of little consequence but said it was in the final stages when Mr Hutton threw caution to the wind and continued riding with the stick.  This resulted with his mount again moving out and bumping FIAMETTE which impeded Mr Innes' action.  Mr Robinson concluded by saying Mr Hutton was careless because his mount had ducked out on 2 previous occasions so he should have concentrated on keeping his mount straight and not riding hard with the whip.

Mr Hutton said Mr Robinson had summed it up in a nutshell.  He admitted he was doing everything to get his mount over the line and should have kept it straight.  However he would not have won if he had not done so. 

Mr Harris agreed that Mr Robinson had explained it all clearly and added that Mr Hutton should not have used the whip in the final stages when his mount was veering out.

Submissions for Penalty:

Mr Williamson produced Mr Hutton's record which showed 4 suspensions for careless riding in the last 12 months.  He said today's charge had resulted in a change of placings depriving punters and connections of revenue.  He submitted the interference was minimal and it was unfortunate Mr Hutton's mount had moved out again after he had straightened it.  Mr Williamson supported a penalty at the lower end of carelessness.

Mr Hutton was then given the opportunity to contact his agent, Mr Dillon, before giving his submissions on penalty.  He resumed by saying he did not have any commitments after the Hastings meeting on 16 July.

Reasons for Penalty:

The committee carefully considered all evidence and submissions before imposing an appropriate penalty.  Mitigating factors are Mr Hutton's admission of the breach and his level of carelessness which the committee finds to be at the low end.  However we must also take into account Mr Hutton's record of 4 suspensions in the last 12 months and a change of placings that occurred through his carelessness.  We are satisfied after questioning that Mr Hutton has recently ridden throughout the North island including Industry days.
