Following race 5 an information was filed pursuant to Rule 871 (1) (d) when it was alleged by the informant, Stipendiary Steward Mr J Oatham that Mr M Sweeney, rider of O'DORCIA committed a breach of that Rule when near the 1600m O'DORCIA shifted in when not clear

Following race 5 an information was filed pursuant to Rule 871 (1) (d) when it was alleged by the informant, Stipendiary Steward Mr J Oatham that Mr M Sweeney, rider of O'DORCIA committed a breach of that Rule when near the 1600m O'DORCIA shifted in when not clear of WATERFORD'S DREAM causing that horse to be checked.
--Mr Sweeney did not admit the breach.
--Mr Williamson demonstrated the video films, which showed the field leaving the front straight on the first occasion. At this stage Mr Sweeney, riding O'DORCIA, was racing three wide and at least two clear lengths ahead of WATERFORD'S DREAM, ridden by C Grylls. Mr Sweeney then steadied his mount to drop back and move in to take a position one off the rails. By easing his mount and moving in Mr Sweeney was not the required distance clear of WATERFORD'S DREAM who had to be checked by Mr Grylls. Mr Williamson stated that in his opinion Mr Grylls did not contribute to the closing of the gap by urging his mount forward.
--Mr Grylls, rider of WATERFORD'S DREAM said he had to check his mount when Mr Sweeney moved in and in front of him. He said he clipped heels as a result.
--Mr Sweeney, rider of O'DORCIA, said he looked in and felt that the gap back to Mr Grylls was a clear 2 - 21/2 lengths. He submitted the gap only became too tight after he had completed his inward movement.
--Mr Oatham stated that it was not evident that Mr Sweeney was the required distance when steadying his mount and moving into the line of Mr Grylls.
--DECISION :
--The Committee carefully considered all evidence and reviewed the video films. We are clearly of the opinion that Mr Sweeney misjudged the distance available to him to make his inward movement. This resulted in Mr Grylls clipping heels with Mr Sweeney, resulting in him having to check his mount. We are satisfied that Mr Sweeney was not the required distance clear and accordingly find him guilty as charged.
--PENALTY SUBMISSIONS :
--Mr Oatham said it was Mr Sweeney's first charge in 18 months since recovering from injury. He said it was a clear case of misjudgement and was at the lower end of carelessness.
--Mr Sweeney submitted his commitments in the next seven days.
--Before imposing penalty the Committee took into account the following :

- The level of carelessness.
Accordingly, we impose a suspension to commence after racing on 16th July and conclude after racing on 25th July 2008 (4 days).
