As Miss Holmquist admitted the breach the Committee finds the charge proved.
Penalty:
The Committee grants Miss Holmquist's request to seek a deferment to her suspension as per rule 1106(2).
Accordingly, the Committee imposes a suspension on Miss Holmquist which will commence after racing on October 5 and conclude after racing on 15 October 2014 (4 North Island days).
Facts:
Following the running of race 4, Northland Business Systems 1200, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Coles, alleged that Miss Holmquist allowed her mount to shift in taking DISCLOSURE (S Spratt) inwards which had to steady causing a check to PERFECT ROSE (J Oliver) near the 900 metres.
Miss Holmquist acknowledged that she understood the nature of the charge, the Rule and confirmed her admission of the breach. Mr J Collett assisted Miss Holmquist at the hearing.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Oatham identified on the video films that passing the 900 metres Miss Holmquist allowed her mount to shift in from a 3 wide position to a 2 ½ wide position. In doing so she was only a bare length clear and this resulted in DISCLOSURE being crowded for racing room. This meant DISCLOSURE had to steady and checked PERFECT ROSE quite sharply on the point of the turn.
Miss Holmquist told the Committee Mr Dell’s mount had moved up past her in a 4 wide position and she was racing tight behind that horse's heels. She said her inward movement was only slight and her mount over reacted to the incident.
Mr J Collett said Miss Holmquist shifted in half a horse width and noted PERFECT ROSE was racing in an awkward spot behind DISCLOSURE. He added the inward movement was not great.
Submissions for Penalty:
Mr Coles produced Miss Holmquist's record which showed 2 previous breaches under this Rule in the last 12 months. He noted Miss Holmquist was issued with a warning from the Stewards for a similar incident near the 900 metres on this track last month. He said this is a reasonable record as Miss Holmquist is a busy rider. He said although Miss Holmquist didn’t shift in a lot PERFECT ROSE did receive a sharp check. Mr Coles submitted a 4 day suspension would be appropriate.
Miss Holmquist was unsure of her future engagements, consequently the Committee granted her time to contact her employer. Mr Collett acknowledged it was appropriate for Miss Holmquist to speak to her employer.
After talking to her employer Miss Holmquist advised she had upcoming engagements at Te Awamutu on October 5, and any proposed suspension could commence after that.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. The Committee have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating factors are Miss Holmquist's admission of the breach and her comparatively good record as an apprentice rider in relation to this rule. The inward shift by Miss Holmquist is minimal however several runners were inconvenienced by her actions.
After taking into account all the above factors the Committee considers an appropriate penalty is a 4 day suspension.
