Accordingly, both INDIAN GIVA and WHO’S QUEEN were declared non-starters as per rule 632.

Facts:

Following the running of Race 2, Fell Engineering 1200, an Information was filed pursuant to Rule 632. The Informant, Mr Coles, requested a ruling to determine whether INDIAN GIVA and WHO’S QUEEN were denied a fair start.

In the interest of expediency and timeliness the Committee elected to hear both matters together. However for the purpose of decision making, the Committee gave separate consideration as to whether or not each horse was denied a fair start.

Rule 632 provides that:

If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter.

Submissions for Decision:

Mr Coles demonstrated on the head on video film that INDIAN GIVA and WHO’S QUEEN gates were clearly slow to open and in his opinion both horses were denied a fair start.

Mr Du Plessis said the video footage was plain to see that his mount INDIAN GIVA was denied a fair start. He said the instructions were to ride his mount forward and he was unable to do so. He added INDIAN GIVA hit his head on the barriers when attempting to jump out.

Mr Wong said that the video evidence clearly shows that WHO’S QUEEN gate was slow to open and it was necessary for him to force the gate open.

Mr Harrison advised the Committee that the films were self – explanatory. He said it was evident both horses had to force the starting gates open and this resulted in both horses losing ground at the start.

Reasons for Decision:

The Committee carefully considered the submissions presented and reviewed the video films. It is very clear INDIAN GIVA and WHO’S QUEEN starting stalls were slow to open due to a mechanical failure. The Committee is satisfied this materially prejudiced their chances. The side on video film is compelling that each horse lost approximately 4 lengths at the start which prevented them from taking an effective part in the race.
