This Committee imposes a fine of $500 on Miss Spratt.

Facts:

Following the running of the TANALISED MILE, RACE 5, 29 June 2019, an Information was lodged by Senior Stipendiary Steward Mr M Williamson against Class A Rider Miss S Spratt, alleging that Miss Spratt used her whip excessively prior to the 100 metres mark when riding O'GUY.

Rule 638(3)(b)(ii) provides : A Rider shall not :

(ii) strike a horse with a whip in a manner or to an extent which is excessive

The Guidelines with respect to Acceptable use of the Whip provide :Rule 638(3)(b)(ii) a rider may be penalised if their whip use is outside of the following guidelines :

Inside the final 600 metres of any race , official trial or jump-out a horse may be struck with the drawn whip up to 5 times after which the rider must cease their use of the whip for a minimum of 5 strides before striking the horse again with the drawn whip , with this restriction to apply prior to the final 100 metres. The whip may then be used at the rider's discretion until the winning post is reached.

Prior to the final 600 metres of a race , official trial or jump-out use of the drawn whip is acceptable if used in moderation and not continually.

Submissions for Decision:

Miss Spratt was present at the Hearing and she advised the Committee that she understood the Rule and the Whip Guidelines and that she admitted the breach.

 

Reasons for Decision:

Mr Williamson demonstrated the incident by use of the race films and showed where prior to the 100 metres mark Miss Spratt used her whip 9 times without the required pause.

Miss Spratt said she did pause but it was not long enough.

Submissions for Penalty:

Mr Williamson said that this was Miss Spratt's second breach in the last 12 months and in terms of the Penalty Guidelines a fine of $500 was appropriate.

Miss Spratt acknowledged that a fine would be imposed.

Reasons for Penalty:

The film evidence is clear and although Miss Spratt has paused in her use of the whip she has not paused for long enough. She has admitted the breach but this was inevitable given the clear film evidence. This is Miss Spratt's second breach of this Rule in the past 12 months. The JCA Penalty Guidelines provide for a fine of $500 for a second breach of this Rule in a 12 month period. This is the appropriate penalty in this instance.
