The Committee therefore suspend Mr Mansour's licence to ride in races from after racing on 8 February 2019 until the completion of racing on 17 February 2019 - 6 National Riding Days.
Facts:
This charge followed the running of Race 6, the Team Wealleans 1600m. Mr Jones alleged that Mr D Mansour 'permitted his mount HELENAOFTROY to shift outwards when not sufficiently clear of SO YOU SPARKLE which was crowded and checked approaching the 200 metres.'
Mr Mansour was present at the hearing and acknowledged that he:
(a) Admitted the breach, and that
(b) He understood the Rule.
Rule 638(1)(d) states: 'A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless'.
Using the available films Mr Oatham identified the horse HELENAOFTROY, ridden by Mr Mansour, as the field entered the final straight. The horse SO YOU SPARKLE ridden by Mr T Harris was outside HELENAOFTROY, with EN SOIE (Mr C Lammas) outside that horse. Mr Oatham pointed out that Mr Mansour was riding his mount along with the whip and allowed the horse to drift outwards approximately 1 1/2 horse widths into the path of SO YOU SPARKLE. Mr Oatham also pointed out that HELENAOFTROY was barely a length clear of SO YOU SPARKLE when Mr Mansour shifted out. At that time there had been a clear run available to SO YOU SPARKLE which Mr Harris was unable to take advantage of as he was forced to check his mount when he was crowded by HELENAOFTROY. EN SOIE, outside of SO YOU SPARKLE, made a slight inwards shift which contributed marginally to the incident.
Mr Mansour said that his mount had it's head up and tried to grab the bit. He said he had changed his whip over to his other hand to try to control the horse but it had already shifted out.
Submissions for Penalty:
Mr Jones advised the Committee that Mr Mansour had been suspended on 23 January 2019 and that suspension was to begin after racing on 31 January and conclude after racing on 8 February 2019. He added that the Stewards placed this incident at slightly below mid-range on the level of seriousness as the effect on SO YOU SPARKLE was serious enough to extinguish any chance it might have had in the race. Mr Jones added that it was clear that a period of suspension of Mr Mansour's riding licence would be appropriate.
Mr Mansour told the Committee that he had only recently re-commenced riding after suffering an injury and added that he was having some financial difficulty at present.
Reasons for Penalty:
The Committee viewed the films independently and we assessed the incident had consequences for the affected rider in the mid-range on the level of carelessness. It was to Mr Mansour's credit that he had admitted the breach. This is his second breach in a matter of 7 days and given he has had approximately 50 rides since he returned from injury, we therefore assess his riding record to be neutral.
The Committee confirmed that the JCA Penalty Guide provided a starting point of a 7 day suspension for a breach of this nature. Given the matters referred to above we feel it is appropriate to apply a suspension of 6 National Days on Mr Mansour.
