Facts:
This protest followed the running of Race 4, the Tracks Concrete Ltd 2100.
The Informant Mr Bayliss, rider of BECAUSE (4th) and representing the connections of that horse alleged interference by SPECTRA placed 2nd by the Judge in the final 100 metres.
The Judge's placings were:
1st No 14 STILTON
2nd No 7 SPECTRA
3rd No 6 TRIOMPHE
4th No 4 BECAUSE
Rule 642(1) states 'If a placed horse or its rider causes interference within the meaning of this Rule to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they place the first mentioned horse immediately after the horse interfered with'.
The official margins were : Long nk; 1 1/2 lgths ; head
All persons present acknowledged they understood the Rule.
Submissions for Decision:
Using the available films Mr Bayliss identified his mount BECAUSE as the field neared the 100 metres mark. He said that he had followed SPECTRA, ridden by Mrs Thornton and was looking to obtain a run outside that horse. He pointed out on the film that he had to check his mount for 4 or 5 strides as SPECTRA moved across in front of him. He said that he had been travelling well about a length behind SPECTRA and this check caused his horse to lose momentum. He added that there had been insufficient room for him to ride his mount out fully and that he had been 'shuffled' back to 4th after making progressive ground. Mr Bayliss stated that he believed he would have finished 2nd ahead of SPECTRA with an un-interrrupted run, and that he should have finished at least 3rd.
When Mr Bayliss was reminded by the Committee that he had protested against the 2nd horse, Mr Oatham explained that at the initial interview immediately after the race Mr Bayliss had stated that he was confident he would have 'picked up' the 2nd horse.
Mrs Thornton said that she acknowledged her horse had been racing greenly and that it had moved across in front of BECAUSE, however she said she had been between 1 and 1 1/2 lengths ahead at the time and she did not believe BECAUSE would have beaten her horse anyway.
Mr I'Anson, representing the trainers of SPECTRA (M Baker and A Forsman) said that he agreed with Mrs Thornton and added that SPECTRA had been well clear of BECAUSE before shifting ground and he did not believe the placings would have been affected by that movement.
Mr Jones said that BECAUSE had been finishing well before suffering interference from SPECTRA at about the 100 metres mark. He added that the Stewards' opinion was that they had difficulty accepting that BECAUSE would have made up the distance it was behind SPECTRA if the interference had not occurred and that the Committee would need to be certain that would have taken place if they were to uphold the protest.
Reasons for Decision:
The Committee carefully considered all of the submissions presented and viewed the films.
It was evident that at about the 100 metres mark BECAUSE had been travelling strongly about 1 to 1 1/2 lengths behind SPECTRA. SPECTRA shifted outwards under a ride and for 4-5 strides BECAUSE was checked and hampered. SPECTRA travelled strongly to the finish and was just beaten by the fast finishing STILTON.
Having regard to the level of interference, the manner in which both horses finished the race off, and the approximate distance of 1 1/2 lengths which BECAUSE was behind SPECTRA the Committee is not satisfied BECAUSE would have finished ahead of SPECTRA.
