Decision:

Following race 8 a protest was lodged by Mrs L Satherley pursuant to Rule 876(1) when she alleged that her mount, SLEEPY JOE, placed 2nd by the judge, suffered interference from MR ARMADEUS, placed 1st by the judge

Following race 8 a protest was lodged by Mrs L Satherley pursuant to Rule 876(1) when she alleged that her mount, SLEEPY JOE, placed 2nd by the judge, suffered interference from MR ARMADEUS, placed 1st by the judge, in the final straight.

--

Mr M Sweeney, rider of MR ARMADEUS, was represented by Mr J Pender.

--

Mrs L Satherley, rider of SLEEPY JOE, was represented by Mr P Stewart.

--

The margin between 1st and 2nd was 21/2 lengths

--

Mrs Satherly used the video to show the field entering the straight. She showed her mount, SLEEPY JOE, racing near the outer and then showed the check that she received. She claimed that this was caused by MR ARMADEUS moving in and taking her line. She said that SLEEPY JOE was a big strider who took a lot of winding up and that she felt that the incident had cost her at least 3 lengths.

--

Mr Sweeney used the head ? on film to show what he claimed was a virtual straight line maintained by his mount and that, in his opinion, any interference was caused by the outward movement of FRENCH BEAU.

--

Mr Coles, Stipendary Steward, when asked for his opinion agreed with Mr Sweeney's evidence and said that he did not think that a change of placings was justified.

--

DECISION: The committee firstly considered whether interference occurred and if so did MR ARMADEUS contribute to it.

--

In our view SLEEPY JOE did suffer interference but it was not caused by MR ARMADEUS.

--

The protest is therefore dismissed and the judge's placings will stand.
