Facts:
Following the running of Race 4 an information Instigating a Protest was filed pursuant to Rule 642. The informant, Mr Sweeney alleged that LIPPY placed 1st by the judge interfered with the chances of his mount SCARLET CHAPARRAL placed 2nd by the judge. The interference was alleged to have occurred in the final straight.
The judge's placings were as follows:
1st No. 2 LIPPY
2nd No. 6 SCARLET CHAPARRAL
3rd No. 3 THE NEMESIS
4th No. 1 HOLD THE DREAM
The official margin between 1st and 2nd was a short neck.
Submissions for Decision:
Mr Sweeney informed the committee he would represent all the connections of SCARLET CHAPARRAL. He demonstrated on the video films that at the 350 metre mark LIPPY shifted out and hampered SCARLET CHAPARRAL which forced him to stop riding his mount. He said there was contact between the 2 horses later in the straight which inconvenienced his mount and denied him a full opportunity to win the race.
Mr Cameron conceded that the 2 horses made contact at the 350 metre mark but stated in his opinion there was movement from both horses in the incident. He demonstrated on the video films that both horses were getting tired leaning on one another in the final straight. He believed that over the final 150 metres SCARLET CHAPARRAL had every opportunity to win the race.
Ms Whiteside concurred with the submissions of Mr Cameron and believed the left handed whip action of Mr Sweeney highlighted the alleged incident.
Mr Sweeney when given the opportunity to sum up concluded that his mount was hampered in the final straight.
Mr Oatham when asked for his assessment of the incident said there was obviously significant interference at the 300 metres when in his opinion LIPPY shifted out onto SCARLET CHAPARRAL. He went on to say that LIPPY shifted out several times in the straight making contact with SCARLET CHAPARRAL. He believed that SCARLET CHAPARRAL was making up some ground on LIPPY over the final stages. He submitted it was up to the committee to decide whether SCARLET CHAPARRAL would have beaten LIPPY if the interference had not occurred.
Reasons for Decision:
The committee carefully considered all the evidence and submissions presented and reviewed the video films several times. We established that at approximately the 300 metre mark there was movement from both LIPPY and SCARLET CHAPARRAL which resulted in solid contact occurring. At the 200 metre mark the 2 horses brushed with Mr Cameron having to stop riding his mount forward with the whip whereas Mr Sweeney continued to ride his mount forward with the whip. At the 150 metre mark the head on video film confirmed that both horses contributed to the bump that occurred at that point in the race. Over the final 100 metres both horses had clear running with SCARLET CHAPARRAL making little ground on LIPPY. While we concede that the protest did have merit the video films do not support that LIPPY was the sole contributor in the contact that occurred in the final straight. In our view LIPPY fought on the strongest in a battling finish in which both horses and riders were briefly hampered on several occasions in the final straight.
Therefore, for these reasons we are not satisfied that SCARLET CHAPARRAL would have beaten LIPPY had such interference not occurred.
