As this breach was admitted we find the charge proved.
Penalty:
Accordingly we suspend Mr Maggorian's license to ride in races from after racing at Te Teko on 26 January until after racing at Tauranga on 5th February, 4 riding days.

Facts:
Following the running of race 1, THE BEACON 1200, an Information was laid by Mr B Jones alleging that apprentice rider Mr L Maggorian had permitted his mount to shift inwards when not sufficiently clear of GLADSTONE BELLE which was checked near the 1000 metres.
Mr Maggorian, who was assisted by trainer Mr P Lock, acknowledged that he understood the Rule, and confirmed that he had admitted the breach.
Rule 638(1)(d) provides' A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless'.
Mr Oatham used the available video films to identify the incident. He pointed out that just prior to the 1000 metre mark, Mr Maggorian riding ATUA was in a 3 wide position. Inside him was GLADSTONE BELLE ridden by Ms S Collett. Mr Oatham demonstrated that Mr Maggorian had looked briefly inside him and then allowed ATUA to shift inwards. At the time he was a 'bare' length ahead of GLADSTONE BELLE and this caused Ms Collett to check her mount, losing approximately 1 1/2 lengths.
Mr Maggorian told the Committee that he had looked inside prior to shifting inwards, however as he angled his mount in PATCHEE JACK ridden by Ms T Thornton had moved back towards him. PATCHEE JACK had been racing ahead of him and this caused him to move further inwards which placed pressure on Ms Collett. Mr Maggorian acknowledged that he heard Ms Collett call out and he said he had relieved pressure on her as soon as he could. He felt Ms Collett had over-reacted to this incident. He added that he felt the incident was at the low end of the scale.
Mr Lock acknowledged that Mr Maggorian had made a slight error of judgement, however he also felt that there had been some pressure on Mr Maggorian from Ms Thornton.
Submissions for Penalty:
Mr Jones produced Mr Maggorian's riding record which showed 2 previous breaches of this Rule. On 24/10/2014 he was suspended for 4 days, and he was also suspended for 4 days on 30/8/2014. Given the number of rides he has as a busy apprentice his record could be classed as good. Mr Jones stated that the Stewards viewed this breach as being at the low end of the scale and felt that a suspension of 4 days would be an appropriate penalty.
Mr Maggorian said he felt the incident was at the low end of the scale and asked the Committee to consider a shorter suspension and a fine as a penalty. He told the Committee that he had ridden at Christchurch during the NZ Cup meeting, and also at the West Coast. He agreed he had not ridden further south than Christchurch.
Mr Lock had nothing to add.
Reasons for Penalty:
The Committee took into consideration all of the submissions and evidence presented. We adopted a 5 day suspension as a starting point as per the JCA Penalty Guide. Given the incident was at the low end of the scale and that Mr Maggorian to this date had a good record in regard to this Rule we believed a 4 day suspension to be an appropriate penalty. We accept that Mr Maggorian took immediate steps to relieve pressure on Ms Collett when she called out to him.
The Committee considered Mr Maggorian's request that he be fined and suspended for this incident, however we did not consider the circumstances prevailed which would allow us to consider that request.
