Accordingly, Ms Spratt had her license to ride in races suspended for a period to commence after racing on 21 June and conclude after racing on 1 July 2015 (5 North Island days).
Facts:
Following the running of race 2, Golden Grains LTD 3YO, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Jones, alleged that Ms Spratt permitted her mount ABSOLUTE GOLD to shift inwards when not sufficiently clear of SCANDINAVIAN which was forced inwards crowding MARIPOSA which was taken into the line of CHAMPAGNE TASTES which was checked passing the 1000 metres.
Ms Spratt acknowledged that she understood the nature of the charge, the Rule and confirmed her admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Oatham demonstrated on the video footage that Ms Spratt was racing on the outside of the field passing the 1100 metres. He identified racing to Ms Spratt’s inside was SCANDINAVIAN, CHAMPAGNE TASTES and MAIPOSA. He said when Ms Spratt shifted in and crowded SCANDINAVIAN that horse raced ungenerously which he believed is a mitigating factor. He added Ms Spratt was not the required distance clear which meant Mrs Thornton had to take evasive action on her mount CHAMPAGNE TASTES.
Ms Spratt had nothing to add.
Submissions for Penalty:
Mr Jones produced Ms Spratt's record which showed 4 previous breaches under this Rule in the last 12 months the most recent being May 2 which incurred a 5 day suspension. He said the level of carelessness is low to mid – range and submitted a penalty should reflect that. Mr Jones submitted that Ms Spratt has ridden in the Central Districts on 3 occasions this year.
Ms Spratt advised that she had upcoming engagements at Te Aroha on 21 June, and sought a deferment to any proposed suspension. Ms Spratt said she had spoken to her Manager who confirmed she was riding in the Central Districts on 19 June. Ms Spratt added that she recently rode at Christchurch but said her Manager had not discussed any future intentions of riding in the South Island.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. The Committee have adopted 5 riding days as the starting point in considering the term of suspension for this careless riding charge. The mitigating factors are Ms Spratt’s admission of the breach and the level of carelessness is low end. However, the consequences of Ms Spratt’s inward shift is 3 horses were checked to varying degrees. The Committee acknowledges that SCANDINAVIAN did race ungenerously when crowded by ABSOLUTE GOLD which is taken into account when fixing penalty.
The JCA records show that Ms Spratt has breached this Rule 6 times previously in the last 12 months. The Committee considers this is a poor record and an aggravating fact.
The Committee notes that Ms Spratt is engaged to ride in the Central Districts on 19 June.
After taking into account all the above factors the Committee considers an appropriate suspension is 5 days.
