As Mr Jones admitted the breach the Committee found the charge proved.

Penalty:

Accordingly, Mr Jones had his license to ride in races suspended for a period to commence after racing on 17 June and conclude after racing on 24 June 2018.

Facts:

Following the running of race 2, Golden Grain Ltd, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr B Jones, alleged that Mr BR Jones allowed BAYAMO to shift in near the 950 metres when not clear of BACK IN A FLASH (A Calder) which was crowded and checked also hampered was ARENARULER (K Cowan)

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Jones acknowledged that he understood the Rule and confirmed that he admitted the breach.

Mr Coles demonstrated the incident using the available video footage. He identified that Mr Jones allowed his mount to shift in when not sufficiently clear of BACK IN A FLASH. As a result that runner was checked and became unbalanced after making contact with the hind quarters of ARENARULER. He said in mitigation BACK IN A FLASH was slow to begin and there was some outward movement from ARENARULER near the 950 metres.

Mr Jones said that he looked to his inside prior to shifting in and he thought he was clear of BACK IN A FLASH. He stated that he shifted in for a stride but took corrective action straight away. He added that ARENARULER shifted out and contributed to the incident.

Submissions for Penalty:

Mr Jones produced Mr Jones’ record which showed no previous breach under this Rule in the last 12 months. He said the Stewards assessed the carelessness to be in the low to midrange with some mitigating factors.

Mr Jones advised the Committee that he had firm engagements on 17 June at Waipa and any proposed suspension could start after that date.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

The video films showed that Mr Jones allowed his mount to shift in 1 horse width shortly after the start when not the required distance clear of BACK IN A FLASH. This result in that runner being crowded and checked which in turn hampered ARENARULER. The Committee deemed the inward shift to be low range and the consequential effects were midrange. Therefore the totality of the carelessness was low to midrange and a starting point of 7 national riding days was adopted.

There were no aggravating factors.

The mitigating factors were Mr Jones’ admission of the breach and his unblemished record. For these combined factors he was afforded a 2 day reduction in penalty.

After taking into account all the above factors the Committee considered that an appropriate suspension was 5 national riding days.
