DECISION & REASON:
Following race two an information was filed pursuant to Rule 616(2)(a). The informant, Mr M Williamson, alleged that the Moroney partnership presented the horse RIO NUGGET without notified gear (pacifiers), (barrier blanket).
Mr D Moroney, representing the partnership, pleaded guilty to the charge.
--Mr Williamson told the Committee that the pacifiers were left behind by mistake following some incident at the stable this morning. However, he said they were notified in the race book, and the omission of pacifiers can have an effect on performance.
--Mr Moroney told the Committee he did not realise that pacifiers were notified in the book until he arrived at the races. He said he tried to borrow some from other trainers, but was unsuccessful.
--PENALTY SUBMISSIONS:
This was the first charge for the Moroneys under this rule and submitted a fine of not less than $250 would be appropriate.
PENALTY:
The Committee considered the evidence as presented before imposing penalty. We give credit to Mr Moroney pleading guilty, and that this was their first charge under this rule. However, leaving pacifiers off when notified is slightly more serious than other gear omissions. Accordingly we impose a fine of $300.
