The protest was upheld and LOTALOV was relegated from 2nd to 3rd placing. Consequent upon the relegation, the amended placings for the race are as follows:
1st 5 Sarah Palin
2nd 2 Royal Pilot
3rd 1 Lotalov
4th 11 No Boundaries
5th 9 Kowhai Whiz
It was ordered that dividends and stakes be paid in accordance with that amended result.
Facts:
Following the running of Race 4, CRT/Ballance Trot, an information instigating a protest was filed by Stipendiary Steward, Mr S P Renault, against LOTALOV (C D Thornley), placed 2nd by the judge, on the ground that it broke over the concluding stages and was lapped on by ROYAL PILOT (B F Crothers), placed 3rd by the judge.
Mr Thornley was not present at the hearing of the information, but he had endorsed and signed the information “I do not contest the protest”.
Rule 870 provides as follows:
(5) Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or horseman, then (subject to Rule 869 (8) such relegation of the horse shall be at the discretion of the Judicial Committee.
The official margin between 2nd and 3rd was half a length.

Mr Renault showed video replays of the final 100 metres of the race. He pointed out LOTALOV, racing in 2nd placing. He also pointed out the marker on the inside of the track indicating the distance 50 metres from the finish. Mr Renault said that the horse was trotting inside the 50 metres but, approximately 10 metres from the finishing line, it went into a gallop and continued in a gallop past the finishing line. It was lapped on by the 3rd placed runner, ROYAL PILOT. Mr Renault produced the official photo finish of the race.
Reasons for Decision:
The Committee was satisfied that LOTALOV was not in its correct gait when its nose reached the finishing line and that it was lapped on by the 3rd placed runner, ROYAL PILOT. The Committee also noted that Mr Thornley did not contest the protest.
