As Mr Golding had admitted this breach of the Rules it was found to be proved in accordance with Rule 1111(1)(d).

Accordingly, Mr Golding was fined the sum of $300.
Facts:
Following the running of Race 6, the Farmlands Cooperative Mobile Pace, an Information was filed by Stipendiary Steward Mr S Wallis against Junior Horseman Mr S Golding, alleging a breach of Rule 869(2)(a) in that he used his whip excessively in the home straight.
Rule 869(2)(a) reads as follows:
“(2) No horseman shall during any race:
(a) Use his whip in an unnecessary, excessive or improper manner.”
Mr Golding had endorsed the Information that this breach of the Rules was admitted. Mr Golding had also informed the Stewards that he did not wish to be present at the hearing.
Mr Renault gave evidence and showed video replays of the final stages of the race where he pointed out Mr Golding, driving HAPPY AS LARRY, who was racing wide and in contention at the home turn. He stated that Mr Golding used his whip on 20 occasions over the concluding stages which he said was clearly outside the whip guidelines. He said that there were 11 forward strikes followed by 9 backhanders which were not overly forceful but submitted the number of strikes was high and the fact that Mr Golding failed to break up his action was the reason he was being charged.

Mr Wallis stated that Mr Golding was a busy driver who had driven on 206 occasions so far this season. He stated he had a clear record in regard to this rule and had admitted the breach at the first opportunity.
Mr Wallis stated the JCA Penalty Guide recommends a starting point of a $500 fine for a breach of this rule. Mr Wallis submitted that a fine of $300 be considered as penalty in this case.
Reasons for Penalty:
In determining penalty, we took into account Mr Golding’s good penalty record and his admission of the breach. In adopting the JCA Penalty Guide starting point of a $500 fine for a breach of this Rule we were able to give Mr Golding a discount of $100 for his good record as well as a further discount of $100 for his ready admission of the breach. We therefore determined that a fine of $300 was an appropriate penalty in this case.
