Accordingly, Mr Cameron’s licence to drive is suspended from the close of racing on the 30 December 2019 up to and including racing on 10 January 2020.
Meetings encompassed in this suspension are January 3 at Rangiora, January 7 at Timaru, January 10 at Nelson.
Facts:
Following the running of Race 10 an Information was filed by Stipendiary Steward, Mr Renault alleging a breach of Rule 869(7A)(b) by Open Driver, Mr I Cameron. The information alleged; in that I Cameron (BRIGHT GLOW) allowed his sulky to protrude inside 4 pylons on the home bend thereby gaining an advantage.
Mr Cameron signed the Information admitting the breach and stated he was conversant with the Rule.
Rule 869 provides as follows:
(7A) Every driver who moves inwards shall ensure:
(b) that any part of the sulky does not protrude inside the marker line.
Mr Renault identified Mr Cameron driving (1) BRIGHT GLOW, in a trailing position at approximately the 350 metres. Mr Renault pointed to Mr Cameron who angled his horse to the inside of (6) MAJESTIC ACTION and could be clearly seen to race inside of four pylons.
Mr Cameron made no submissions regarding the incident.
Submissions for Penalty:
Mr Renault alluded to the Penalty Guidelines which have a starting point of a 4-drive suspension or a $200 fine. He reminded the Committee this charge has followed a protest which resulted in BRIGHT GLOW being disqualified from its fourth placing. He said the Stewards would be seeking an uplift in Penalty to reflect the disqualification, the effect on punters and the connections of the horse.
Mr Renault said Mr Cameron averaged 2 drives per race day.
Mr Cameron had nothing to add only to say he and his wife were the connections of the horse.
Reasons for Penalty:
The JCA Penalty Guide provides a 4-drive suspension or a $200 fine as a starting point for a breach of this Rule.
The aggravating factor, we determined was the effect on punters and connections as a result of the disqualification, due to Mr Cameron’s actions, which warrants an uplift from this starting point.
For these reasons we uplift the Penalty by 4 drives to an 8-drive suspension which we equate to a 4-day suspension.
The mitigating factors are Mr Cameron’s clear record and admission which the Committee afford a discount of one day.
Considering all the above factors the Committee find a 3-day suspension is an appropriate penalty in this case.
