Facts:
Following the running of Race 10, TRT Builders Handicap Trot, an Information instigating a protest was filed by Stipendiary Steward, Mr SP Renault, against SUNNY GLENIS (R G Anderson), placed 3rd by the judge, on the ground of interference to CELTIC THUNDER (BN Orange), placed 4th by the judge, in that “SUNNY GLENIS shifted outwards in the early stages of the home straight checking CELTIC THUNDER”.
Mr Anderson, trainer and driver of SUNNY GLENIS, had signed the Statement by the Respondent on the information form indicating that he admitted the breach and also that he did not wish to contest the protest.
Rule 869A provides as follows:
(2) When a placed horse or its driver causes interference to another placed horse and the Judicial Committee is satisfied that the horse interfered with would have finished ahead of the horse that, or whose driver, caused the interference the Judicial Committee must, in addition to any other penalty that may be imposed, place the horse who, or whose driver, caused the interference immediately after the horse interfered with irrespective of where the interfered horse finishes.
The judge’s placings were:

Submissions for Decision:
Mr Renault showed video replays of the final 400 metres of the race. He pointed out SUNNY GLENIS, racing in the parked position outside the leader with CELTIC THUNDER behind it in the one-one as the field approached the home straight. After turning for home, SUNNY GLENIS ran outwards and ducked out sharply on Mr Orange’s horse at about the 170 metres. Mr Orange’s horse, CELTIC THUNDER, lost several lengths (Mr Renault estimated 3 lengths) and its momentum. It recovered to get within a ½ length of SUNNY GLENIS at the finish, continuing to make ground on that runner after recovering from the interference, Mr Renault said.
Mr Renault submitted that it was easy to say that CELTIC THUNDER would have beaten SUNNY GLENIS, but for the interference from that runner. Mr Anderson had accepted that and, hence, he was not contesting the protest, Mr Renault said.
Mr Renault sought the relegation of SUNNY GLENIS to 4th placing.

The Committee was satisfied that SUNNY GLENIS had caused interference to CELTIC THUNDER approximately 170 metres from the finish. CELTIC THUNDER lost, according to Mr Renault, possibly 3 lengths at a point in the race where it was mounting its run to the finish. It made ground from that point on SUNNY GLENIS and the official margin at the finish between 3rd and 4th was a ½ length.
We needed to be satisfied that, but for the interference, CELTIC THUNDER would have beaten SUNNY GLENIS. We were so satisfied having regard to the ground lost by CELTIC THUNDER, the margin at the finish, the fact that it was making good ground on SUNNY GLENIS towards the finish and, finally, that Mr Anderson was not contesting the protest.
