Accordingly, Mr Geddes is fined $250.

Facts:

Following the running of Race 9, an information was filed by Stipendiary Steward, Mr Renault, against Open Driver Mr J Geddes alleging that “Driver J Geddes allowed his runner (RAZORS EDGE) to strike the wheel of HOMEBUSH LAD near the 900m causing the sulky tyre to deflate”.

Mr Geddes signed the Information admitting the breach, and stated he understood the Rule.

Rule 869(3) (b) provides as follows:
(3) no horseman in any race shall drive:
(b) carelessly

Mr Renault used the race video to identify Mr Geddes driving RAZORS EDGE at approximately the 800 metre mark. He pointed to Mr Geddes shift his horse from the rail out on to the back of HOMEBUSH LAD (B Hope) and in doing so clip Mr Hope’s near side tyre which deflated immediately.

Submissions for Penalty:

Mr Renault said Mr Geddes has a clear record under this Rule and has admitted the breach at the earliest opportunity. He said his manoeuvre affected HOMEBUSH LAD’S chances as the horse tired in the straight to finish behind the field by some distance. He said he would leave it to the Committee to determine an appropriate Penalty.

Reasons for Penalty:

The JCA penalty Guidelines for the Rule provides a starting point of a $300 fine or a 6-drive suspension any time a driver hits a wheel. The Committee’s assessment of the breach is that a fine is appropriate.

The contact to Mr Hope’s tyre could best be described as a brush but the consequences could possibly have been a factor in HOMEBUSH LAD finishing at the rear of the field

The mitigating factors are Mr Geddes’s admission of the breach and his good record.

There are no aggravating factors here.

The Committee having regard for the above factors, considered a $250 fine as an appropriate penalty in this case.
