Decision: Following the running of Race 1, the Calendar Girls Pace, an information was laid by Stipendiary Steward Mr N. G. McIntyre against Mr K. Cameron, the driver of “Galleons Ambition” (12), alleging that he had committed a breach of Rule 869(2)(a) in that he used his whip excessively.

Following the running of Race 1, the Calendar Girls Pace, an information was laid by Stipendiary Steward Mr N. G. McIntyre against Mr K. Cameron, the driver of “Galleons Ambition” (12), alleging that he had committed a breach of Rule 869(2)(a) in that he used his whip excessively.   Mr Cameron is a Junior Horseman and he was assisted at this hearing by Mr C. D. Thornley.

Mr Cameron had indicated on the information that he admitted this breach of the Rules and he confirmed this at the hearing.  Mr Cameron and Mr Thornley also agreed that they understood the charge, the Rule and the “Use of Whip” guidelines.

Mr McIntyre gave evidence and used video coverage to show that Mr Cameron had used his whip in the run home on about 25 occasions.

Mr Cameron explained that he had not hit his horse on all of the occasions he was seen to use it, and that some of these strikes had hit nothing at all.   It was agreed however that the use of the whip was in breach of the guidelines, and hence the admission of guilt.

In relation to penalty Mr McIntyre advised that Mr Cameron had received a caution in Victoria, but that he had no previous convictions under this Rule.    A fine of $200-00 was recommended.

On behalf of Mr Cameron Mr Thornley said that he thought that the fine was too much for a Junior Horseman.  I asked if he could point to any previous occasion where a fine of less than $200-00 had been imposed, and he could not.

Taking into account all the above matters I was satisfied that a fine of $200-00 was appropriate in the circumstances.  Accordingly Mr Cameron was fined the sum of $200-00.
