The Committee ruled that the Official Result of Placings be confirmed.

Facts:

Following the running of Race 1, the Railway Hotel Hokitika Maiden, an information was filed by Stipendiary Steward, Mr M Davidson, requesting a Ruling under Rule 631(8)) as to whether to confirm the result of the race or declare the race void due to the starter loading the field in reverse order.

Rule 631(8) provides as follows:

(8) If any horse starts from an incorrect stall position, the Judicial Committee shall have the discretion to confirm the Official Result of Placings, declare the race to be void or declare any horse in the Race to be a non-starter.

Submissions for Decision:

Mr Davidson explained that the starter had loaded the field in reverse order due to the starting gates being numbered 1 to 12 from the outside. He also explained that the gates are the same as used at Reefton, Greymouth and Kumara where the tracks are left handed. Hokitika being a right-handed track left the starting stall numbers from inside out in reverse to what they should be for this track.

Mr Davidson said that the Stewards questioned all riders involved, with only Miss Comignaghi on LETZPARTYON, drawn 4 but starting from the 6-barrier position, stating that she may have been inconvenienced by being not quite as wide over the early stages had she started from the correct stall. LETZPARTYON started out of barrier stall 6 instead of barrier stall 4. He said she did not qualify this statement but however, went on to say that she believed that her horse would not have finished any closer in the placings, regardless and therefore not disadvantaged. Mr Davidson went on to say that when questioned, all other riders stated that they were not disadvantaged by starting from the incorrect barrier stalls.

Of note, he said, that the favourite, FANTASY FLIGHT, had drawn 1 but started from the outside stall instead, was clearly not disadvantaged and went on to win the race. He added that the only runner to start in the correct stall was TED TALKS who had drawn the middle of the field, in barrier 5.

Reasons for Decision:

The Committee, after hearing all relevant evidence and viewing the race, determined that all runners, despite starting from incorrect stalls, were not disadvantaged and using our discretion under the rule, confirmed the Official Result of Placings.
