As Miss Wynne had admitted this breach of the Rules it was found to be proved.
Penalty:
We therefore determined that Miss Wynne’s apprentice jockey's license be suspended from the conclusion of racing on Saturday 17 January 2015 until the conclusion of racing 19 January 2015 which encompasses the days racing at Wellington 19 January, Gore on 22 January, Wellington or Ashburton 24 January, Ashburton on 28 January and Hawkes Bay on 29 January 2015 (5 effective days).
Facts:
Following the running of Race 4, the Birchfields Coal & Landscaping Hokitika Businesses Cup, an Information was filed by Stipendiary Steward, Mr N Ydgren, against Apprentice jockey, Miss S Wynne, the rider of VIEW, alleging careless riding passing the 500m by shifting inward when not clear, causing RIGHT ROYAL ROSE, ridden by Mr J Oliver, to be checked.
Rule 638(1)(d) provides:
“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”
Miss Wynne had indicated on the Information that this breach of the Rules was admitted and she confirmed this at the hearing. Miss Wynne also agreed that she understood the charge and the Rule it was brought under. Miss Wynne advised the Committee that she did not need assistance at the hearing as she had had Mr K Harrison assist her in the Stewards' investigation of the incident.
Mr Ydgren gave evidence and used video coverage to show that passing the 500m, VIEW, ridden by Miss Wynne, was racing in a one off position and trailing YA DREAMIN JONESY, ridden by Miss J Morris, with RIGHT ROYAL ROSE, ridden by Mr J Oliver on the rail. Miss Wynne when attempting to improve shifted inwards to take up a position on the rail and in doing so was not clear and caused a check to RIGHT ROYAL ROSE. Mr Ydgen stated that RIGHT ROYAL ROSE was weakening but was still entitled to its racing room. Mr Ydgren also said that Miss Wynne was at no stage, throughout this manoeuvre, clear of RIGHT ROYAL ROSE.
Miss Wynne stated that she had been trailing YA DREAMIN JONESY who at this point in the race was tiring and starting give ground. She said that VIEW was travelling well at this time and she opted to shift inwards to take up a position behind the leader who had quickened and in doing so had checked Mr Oliver riding RIGHT ROYAL ROSE.
Submissions for Penalty:
Mr Ydgren stated that the Stewards assessed the breach as mid-range. He said that Miss Wynne’s record over the previous 12 months was not good and showed 4 breaches of this rule. The details of these breaches were 5 days suspension on 8 November 2014 at Christchurch, 3 days at Timaru on 29 June 2014, 3 days at Dunedin on 29 June 2014 and 2 days at Riverton on 19 April 2014. Mr Ydgren stated that Miss Wynne was a very busy rider and rides with considerable success in the South Island and Central Districts. Mr Ydgren submitted that a suspension of 4 days be considered as penalty in this case.
Miss Wynne submitted that she would like a 3 day suspension to be considered as penalty.
Deferment of penalty was discussed with Miss Wynne advising she had declared rides at Wellington on Saturday 17 January and opted to begin any suspension after that date.
Reasons for Penalty:
In determining penalty the Committee took into consideration all aggravating and mitigating factors. The JCA Penalty Guide provides a starting point of 5 days for a breach of this Rule. This case warranted an uplift in the starting point of 1 day to 6 days for Miss Wynne's record, which was not good. The only mitigating factor was her admission of the breach for which we gave a discount of 1 day. We therefore determined that a 5 day suspension was an appropriate penalty in this case.
