Decision:

As Miss Wynne had admitted this breach of the Rules it was found to be proved.

Penalty:

We therefore determined that Miss Wynne’s Apprentice Jockey's license be suspended from the conclusion of racing on Saturday 16 January 2016 until the conclusion of racing on 3 February 2016 which encompasses the days racing at Gore on 23 January, Woodville on 25 January, Riccarton on 27 January, Riccarton on 30 January and Gore on 3 February 2016.

Facts:

Following the running of Race 4, the Birchfields Coal & Landscaping Rating 85, an Information was filed by Stipendiary Steward, Mr N Ydgren, against Apprentice Jockey, Miss S Wynne, the rider of PINSGOLD, who shifted inwards near the 500m when not clear, causing UPPLAND, ridden by Mr D Chin to be severely checked and WAITINO BISCUIT, ridden by Miss M Dravitski, to be badly crowded.

"(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:

(d) careless”

Miss Wynne had indicated on the Information that this breach of the Rules was admitted and she confirmed this at the hearing. Miss Wynne also agreed that she understood the charge and the Rule it was brought under. Miss Wynne was assisted at the hearing by Licensed Trainer, Mr N Coulbeck.

Mr Ydgren gave evidence and used video coverage to show that passing the 500m, PINSGOLD, ridden by Miss Wynne, was racing in a three wide on the outside of the leaders with UPPLAND, ridden by Mr Chin and WAITINO BISCUIT, ridden by Miss Dravitski, on her inner. Miss Wynne shifted inwards in an attempt to take up a trailing position behind the leaders when only ½ to ¾ of a length forward of UPPLAND causing a severe check to UPPLAND. He stated the horse inside UPPLAND, WAITINO BISCUIT, was badly crowded in this incident and as a result Miss Dravitski lost the use of a stirrup iron. He stated that Mr Chin was put in a very precarious position as was Miss Dravitski, who was checked as well.

Miss Wynne stated that her mount, PINSGOLD, was “shaved” shortly after the start and before the crossing. She stated that PINSGOLD was a 9-year-old now and it was his first time racing right handed. Miss Wynne said that the horse began to race erratically and that was the reason she chose to improve towards the lead down the back straight. She said that her horse was still racing erratic when approaching the bend out of the back straight and was looking to take on the leaders. She stated that Mr Lowry riding A BOB SHORT had shifted from a 2 wide position to a 3 wide position on the outside of the leaders when she opted to shift in to gain the trail behind the leaders. Miss Wynne stated that her horse had over reacted and stepped in on the bend which had contributed to the incident. When asked to comment on this, Mr Ydgren stated that the incident was simply a bad misjudgement by Miss Wynne.

Submissions for Penalty:

Mr Ydgren stated that the Stewards assessed the breach as mid-range and the consequences of her carelessness as mid to high. He said that Miss Wynne’s record over the previous 12 months was not good and showed 4 breaches of this rule. The details of these breaches were a 3-day suspension on 17 May at Riverton, 3 days and a $400 fine at Oamaru on 19 July, 4 days at Dunedin on 22 October and 4 days at Cromwell on 29 November 2015. Mr Ydgren submitted that a suspension of 5 days be considered as penalty in this case.

Miss Wynne stated that she rode from time to time in the Central Districts and submitted that this be taken into account when assessing penalty. Mr Ydgren had no objection to relevant Central Districts days being included and submitted that there was only one day that was relevant which was Woodville on 25 January.

Deferment of penalty was discussed with Miss Wynne advising she had engagements at Greymouth on Saturday 16 January and requested any suspension to begin after that date.

Reasons for Penalty:

In determining penalty, the Committee took into consideration all aggravating and mitigating factors. The JCA Penalty Guide provides a starting point of 3 days for a South Island rider for a breach of this Rule. The aggravating factors in this case warranted an uplift in the starting point of 3 days to 6 days for the level of carelessness and consequences of that carelessness, which we assessed as mid to high, as well as Miss Wynne’s penalty record which showed 4 breaches of this rule since May 2015, a period of 8 months. The Committee assessed Miss Wynne ’s record as poor. The only mitigating factor was her admission of the breach for which we gave a discount of 1 day. We therefore determined that a 5-day suspension was an appropriate penalty in this case.
