REQUEST FOR A RULING:
Stipendiary Steward Mr M. R. Davidson filed an information seeking a ruling as to whether “Win Win” (10) was denied a fair start in Race 8, the West Coast Scrap & Steel Rating 75, and also whether that horse should be declared a non-starter.
--The Information reads as follows.
--“I, the abovenamed informant hereby apply to the judicial committee and seek a ruling on the following matters: Rule 632 – The gate for Win Win (A. Mundy) failed to open.”
--Rule 632 provides as follows.
--“If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter.”

Video coverage of the start of this race was shown, and it could clearly be seen that the gate of “Win Win” (second from the outside) was late in opening.
Miss Mundy said that her horse had to force its way out of the gate, and that it lost considerable ground. Miss Mundy also said that her horse liked to lead in a race, and because of this incident the horse lost its chance.
--Mr Davidson said that the video clearly showed the starting stall malfunction, and that this had materially prejudiced the horse’s chances.
--The race Starter, Mr Creagh, said that he was not aware there had been a problem at the time the race started.
--After seeing the video coverage, and after hearing from the persons involved we were satisfied that, in terms of Rule 632, “Win Win” was denied a fair start because the starting gate was slow in opening. We were also satisfied that “Win Win’s” chances were materially prejudiced.
--Accordingly we made a ruling that “Win Win” be declared a non-starter.
