Following the running of race 3 on the programme, an Information was lodged against jockey, LM Robinson, alleging a breach of Rule 871(1)(d) - careless riding.
Following the running of race 3 on the programme, an Information was lodged against jockey, LM Robinson, alleging a breach of Rule 871(1)(d) - careless riding. The Information alleged that, near the 1400metre mark, as rider of Partywiththeboys, he allowed his mount to move inwards causing checks to Bearable (TC Newton) and African Princess (AM Mundy) Mr Robinson denied the breach..
----Introducing his evidence, stipendiary steward Mr Ching first spoke with Ms Mundy . She said she was the rider of African Princess and she said she received interference near the 1400metre mark, and was checked out of the race. She said this came from her outside and she called out to [TC Newton] but there was pressure on her outside.
----Ms Newton (Bearable) then confirmed she was on the outside of Ms Mundy with Mr Bullard (La Calista) outside her. She said she received interference from her outside and this was through pressure outside him.
----Referring to the film, Mr Ching pointed out the positions of the horses and riders. He showed that, shortly after the start, 'slowly and surely? pressure came from Mr Robinson on the outside, and Ms Mundy, who had drawn 1 and was on the fence, had to check out of the race. He said there was no pressure on the outside of Mr Robinson and, as the inside horses ran out of room, Mr Robinson finished up 2-2 ? horses off the fence.
----Mr Bullard (La Calista) was then introduced. He said that, approximately 75metres after the start, he received pressure on his outside which contributed to his being pushed down toward the fence where there were two runners inside him. ..2

----He confirmed that pressure came from Partywiththeboys but he was unsure if there was pressure outside that horse.
----Mr Robinson then briefly addressed a question to both Ms Mundy and Ms Newton. To him, they both indicated they were in position on the fence, and were not improving into it, when the interference occurred.
----Concluding his summation, Mr Ching conceded the contour of running rail may have contributed but he reiterated that there was no pressure on Mr Robinson, and he had created a pincer movement, and the other riders had been squeezed out because he had taken their line. He said that Mr Robinson had a duty to protect the riders inside him, particularly with the contour of the rail as it is.
----Referring to the film, Mr Robinson said he was a victim of circumstances, with pressure on him and, whilst he went straight, there was general tightening and the kink in the running rail dictated his line. He conceded the horses were entitled to be where they were and he did not realise the contour of the rail was as it was. He felt he was ?the meat in the sandwich? and, if he eased out of it, he was going to be in trouble himself but he realised they were there and he eased out later to ease the pressure.
----To the chairman, he said he kept his line after the start but, on reflection, he obviously had to keep out to make allowance for the running rail. He agreed there was some interference but said he felt he was clear until the horses and the kink in the rail came together.
----At this point, and after again referring to the film which he had only briefly seen once soon after the race (this hearing was held at the end of the day), Mr Robinson sought leave to change his plea.
----He conceded the interference had occurred and, until seeing the replays of the film, he was only going on his memory of the incident. He did reinforce, however, that the other horses improving on the inside and the kink in the rail did contribute.
----The change of plea was accepted and, with the Information so endorsed, the charge was thus found proved. With the circumstances well-explained, submissions were sought in relation to penalty.

Mr Ching said Mr Robinson has a very good race riding record. He said he is a senior rider who is rarely seen in the judicial room. He gave credit to him for recognizing the interference occurred and changing his plea, but felt that rider safety was compromised in this case and he sought a suspension of the rider's licence. .
----Mr Robinson confirmed his record and indicated, with all his riding, that he hadn?t had a suspension in the last 18months. He felt, in todays situation, that he hadn?t been helped by the kink in the rail and he asked that that also be taken into consideration.

----Mr Robinson, without the benefit of viewing the film, initially defended the matter and evidence was heard from three other riders in the race, two particularly affected. Subsequent to that, and on viewing the film, Mr Robinson changed his plea and acknowledged the breach, and for that, is to be given considerable credit in considering a penalty.
----In that regard, we have heard submissions from Mr Ching, who acknowledged Mr Robinson's excellent record. Whilst he said he had been warned on two previous occasions for a similar breach, in determining this particular case, we do not place emphasis on those warnings. He is to be given credit for his guilty plea and for the excellent riding record and I have to say, as a senior rider, we seldom see him in the room.
----Mr Robinson himself confirmed that and said, in his evidence and statement to the committee, that he felt the kink in the rail was considerable and contributed to the interference.
----We don?t accept that the contours of the rail had the emphasis on the interference that he believes it had and, given that two horses received checks, one quite severely, we are satisfied that a suspension is appropriate.
----In such circumstances, we accept that three days would be a minimum but, given credit for his acknowledgement of the breach and other factors mentioned, we are satisfied in this instance, that a two day suspension is appropriate, and we so order. Mr Robinson is suspended up to and including Saturday 17th March
