In relation to race 2 on the programme, an information was lodged against trainer, Mr M Pitman alleging a breach of Rule 828(1)(2) in that he failed to scratch True Blue by the required time of 7.30am
In relation to race 2 on the programme, an information was lodged against trainer, Mr M Pitman alleging a breach of Rule 828(1)(2) in that he failed to scratch True Blue by the required time of 7.30am. Mr Pitman admitted the breach.
----Explaining the circumstances, stipendiary steward Mr Ching said that shortly before 8.00am Mr Pitman rang him and indicated he had made a mistake in that he had forgotten to scratch True Blue from race 2. As a result, True Blue was late scratched by the stewards. Mr Ching said that Mr Pitman was open and honest and, not having previously appeared on a charge of this nature, he recommended a penalty in the order of $100.00, which is consistent with this breach.
----In openly admitting the breach, Mr Pitman acknowledged there were no extenuating circumstances and it was a simple mistake. In relation to penalty, while accepting a fine was recommended, he considered a warning may suffice given his involvement over the years and this being the first such a breach.

----In this case, Mr M Pitman appears on a charge under Rule 828(1)(2) in that he failed to scratch True Blue by the required time of 7.30am. Mr Pitman has admitted the breach and we have heard submissions from both Mr Ching and Mr Pitman.
----We are satisfied, in the circumstances, the recommendation from the stipendiary stewards in relation to penalty is appropriate. ..2

The committee appreciates Mr Pitman's efforts with racing, particularly with racing on the West Coast, but an important aspect in relation to penalty is also consistency. We accept it was a simple error and, should it have been anything other than that, we are sure the recommendation from the stipendiary stewards for a higher penalty would have ensued.
----We accept the recommendation as being fair, taking the consistency factor into consideration, and I am sure Mr Pitman appreciates a fine of $100 is not inappropriate and, in this instance, we so concur. Mr Pitman is fined $100.
