Following the running of the third race at Trentham today, Ms Myers (assisted by Mr R Hannam) lodged a protest alleging that Lord Spectrum or its rider, placed second by the Judge, interfered with the chances of Donna Jazz, placed third by the Judge. The interference was alleged to have occurred over the latter stages of the race.

Following the running of the third race at Trentham today, Ms Myers (assisted by Mr R Hannam) lodged a protest alleging that Lord Spectrum or its rider, placed second by the Judge, interfered with the chances of Donna Jazz, placed third by the Judge. The interference was alleged to have occurred over the latter stages of the race.

Mr McCutcheon reserved the right to charge and gave evidence that the official margin between the second and third placed horses was a long neck.

Ms Myers gave evidence, using video footage showing front, side and rear perspectives to illustrate her evidence. Her evidence was that in the run home down the straight, she had positioned Donna Jazz behind Lord Spectrum, which was on the rails, and other horses and was waiting for a gap so she could make a run. A gap opened on the outside of Lord Spectrum and she took it. Her horse then started to make ground on Lord Spectrum but that horse began to shift out, dictating her line and interfering with her ride, and it continued to do so until the finish. She said that as a result of having a line dictated, she couldn?t really ride out her horse and that that cost her second place.

Mr Hannam reiterated what Ms Myers said and pointed out that this had occurred over the last 50 to 75 metres of the race. Ms Myers' mount was forced over extra ground. Mr Davies, Trainer of Donna Jazz agreed the evidence given by Ms Myers and Mr Hannam.

Ms L Cropp, rider of Lord Spectrum, said that the gap was there for Ms Myers to take. She acknowledged that her horse started shifting out but said that it happened so close to the finishing line as to not make any difference to the result. Mr E Rayner, who was representing Mr Priscott, agreed with the evidence of Ms Cropp.

The Committee concluded that Donna Jazz suffered interference from Lord Spectrum in the closing stages of the race. This occurred when Lord Spectrum shifted out over the final 50m of the race into the line of running that Donna Jazz was entitled to. Lord Spectrum continued to dictate the line of Donna Jazz until the finish.

The Committee then had to decide whether the interference suffered by Donna Jazz affected that horse's chances of finishing in a higher place. In this case that meant beating Lord Spectrum into second place. The Committee noted that the interference occurred over a very short distance, about 50m, at the end of the race.

The Committee considered the way in which both Donna Jazz and lord Spectrum were finishing the race before the interference occurred. They also considered the way both horses finished after the interference occurred and the margin between them, a long neck, at the finish. The Committee came to the conclusion that it was not prepared to say that Donna Jazz would have come second if the interference had not occurred. For that reason, the Committee dismissed the protest and confirmed the placings made by the judge.
