As the charge was admitted it was deemed proved by the Committee.

Penalty:

Mr Pinn’s Apprentice Jockey’s Licence was suspended from the end of racing on 15 December 2018 until the conclusion of racing on 26 December 2018.

Facts:

Following the running of Race 9 (GO RACING PREMIER) Information No. A8850 was filed with the Judicial Committee. It was alleged by the Informant that Mr W Pinn the Rider of JESSIEGEE angled his horse out near the 700m when not clear of NEESON (S Spratt) and ALLURE (T Taiaroa) which were hampered.

Rule 638(1)(d) provides:

A rider shall not ride a horse in a manner which the Committee considers to be:

(d) careless

Mr Pinn said that he understood the Rule, the Charge preferred against him and confirmed that he admitted the breach.

Mr Goodwin showed all film replays and identified the three horses involved. He said that Mr Pinn angled his mount away from near the running rail with 700m to travel when not clear of NEESON and ALLURE with both runners being hampered. He said that the riders of both horses had to take hold of their mounts and as a consequence both horses lost ground. He said Mr Pinn and his mount were only half a length clear when shifting out. He concluded by saying that there was not a run ahead and that Mr Pinn just came out.

Mr Walsh, assisting Mr Pinn, said that it was pretty clear that it was a deliberate move by Mr Pinn and that the shift had virtually taken the other two horses out of the race. He said that it was an unnecessary move and inexperienced riding. He said that Mr Pinn has had a number of rides in a relatively short period of time but is still inexperienced, particularly when riding on premier days.

Submissions for Penalty:

Mr Oatham said that the record showed that Mr Pinn had had two suspensions during the last 12 months, those being 9 August 2017 (5 days suspension) and 8 September 2017 (7 days suspension). He said that Mr Pinn had had 240 rides up until today and was still on a learning curve. He said that the move by Mr Pinn was deliberate which was caused by impatience and inexperience. He placed the carelessness in the mid-range category.

Mr Walsh reiterated that Mr Pinn had had a lot of rides in a short period of time. He said that he has to learn to be more patient and that will come with more race riding experience.

Mr Pinn was comfortable with Mr Walsh’s submissions and had nothing further to add.

Reasons for Penalty:

The Committee considered all of the submissions placed before it. It was clear from the films that Mr Pinn had moved outwards near the 700m to obtain a clear run when he was not the required distance clear. In doing so he forced NEESON out onto ALLURE with both horses being forced wider on the track and having to be steadied by their respective riders. The Committee independently assessed the carelessness to be in the mid-range category. Taking into account the admission of the breach, the degree of carelessness, two horses suffered interference, the relative inexperience of Mr Pinn and the JCA Penalty Guide, the Committee determined that an 8 riding-day period of suspension was the appropriate end result.
