As the Charge was admitted it was deemed proved by the Committee.

Penalty:

Ms C O’Beirne’s Apprentice Jockey’s Licence was suspended from the end of racing on 7 March up to and including all racing on 19 March 2020. (Gore on 8 March was not included as declaration of riders already closed).

Facts:

Following the running of Race 8 (Head To Flamingo Joes After The Last 1600) Information No. A12316 was filed with the Judicial Committee. It was alleged by the Informant that Ms O’Beirne allowed her mount to shift in near the 900m when not clear of VROOM (H Andrew) and MONKEY SHOULDER (D Turner) which was checked.

Ms O’Beirne said that she understood the Rule, the Charge and confirmed that she admitted the breach.

The film replays were shown with Mr Goodwin identifying all 3 runners. He said that as they approached the 900m Ms O’Beirne and her mount were in a 3-wide position racing outside of VROOM, with MONKEY SHOULDER racing adjacent to the running rail. Mr Goodwin said that Ms O’Beirne let her horse go from being 3-wide to one-off the fence. As a consequence of the shift VROOM was moved down onto MONKEY SHOULDER who was checked. Mr Goodwin said that Ms O’Beirne and her mount FLORAL BELT was 3/4 to 1 length clear of VROOM when first shifting.

Ms O’Beirne said that she was happy with the charge as she had tightened them up and that she was only following the leader. She added that her horse had changed to the inside leg and that was when the interference happened.

Ms Clapperton said that Ms Andrew the Rider of VROOM did not read the race very well and that she could have relieved the pressure.

Submissions for Penalty:

Mr Goodwin said that Ms O’Beirne had a good record for the number of rides she has had with her most recent breach for careless riding being in November 2019. He invited the Committee to consider imposing a term of suspension.

Ms Clapperton said that Ms O’Beirne was very unlucky in that Ms Andrew did not read the race properly.

Ms O’Beirne said that she did have a good record and that a suspension of her Licence could start immediately.

Reasons for Penalty:

It was clear to the Committee that Ms O’Beirne had ridden carelessly near the 900m, with MONKEY SHOULDER receiving a relatively severe check and losing approximately 3-4 lengths. The Committee placed the carelessness in the mid-range category and after taking into account the admission of the breach and Ms O’Beirne’s good record, it was determined that a 7-Riding Day Suspension was a condign penalty.
