Following the running of the www.trentham.co.nz Jumpers Flat, Mr E Lamb, rider of GALLANT SON, was charged with careless riding under rule 871 (1)(d).

The essence of the charge was that Mr Lamb allowed his mount to shift in at about the 200 metre mark forcing DEACON BRODIE, ridden by Ms K Murray, inwards on to FENMAN, ridden by G Walsh, which had to be eased out of its rightful running line.

Mr Lamb denied the charge. Mr Walsh, rider of FENMAN, stated that DEACON BRODIE's inward movement forced him to take hold of his mount and ease him around DEACON BRODIE to obtain a clear run.

Ms Murray stated that GALLANT SON rolled in on DEACON BRODIE causing her to take hold to avoid clipping heels and in turn squeeze FENMAN out of its rightful running line.

Stipendiary Steward Mr Ray used the rear, head and side on films to indicate the movement from GALLANT SON and subsequent effects on DEACON BRODIE and FENMAN.

Mr Lamb initially asserted that there was not a gap for FENMAN and that DEACON BRODIE was a beaten runner at the point that GALLANT SON rolled in. He submitted that GALLANT SON was not fully fit and not always the easiest horse to ride. He emphasised that any interference to the other horses was a consequence of a difficult ride and issues of judgement, rather than abject carelessness.

The Committee reflected on the submissions put to it and reviewed the films. We find that GALLANT SON did roll in when insufficiently clear of DEACON BRODIE which in turn was forced inwards on to FENMAN's running line. FENMAN was sharply checked as a result. Mr Lamb did not corrective action until after the full effects of his wayward line had taken their toll on other runners. We find the breach proved.

On the issue of penalty, Mr Goodwin advised that Mr Lamb had not been charged under this rule for four years but nevertheless the significant interference caused to two horses warranted a suspension. Mr Lamb submitted that GALLANT SON was not an easy horse to ride and that the incident was occasioned by misjudgement rather than carelessness.

We consider that the degree of carelessness evident in this matter is not at the top end but nevertheless is of an order that warrants a suspension. In setting the term we have given Mr Lamb considerable credit for an excellent riding record and acknowledge that his actions on this occasion were an error of judgement. We therefore suspend him from the close of racing on 11 April 2007 until the close of racing on 14 April, a two day suspension.
