HUGO THE BOSS was declared a non-starter and dividends were authorised to be adjusted accordingly.

Facts:

Following the running of Race 3, the Vision Enhancement- Audio Visual Specialists Wakefield Challenge Stakes Group 2, the Stewards requested a ruling in relation to Rule 632 in that HUGO THE BOSS was denied a fair start by being struck by the barrier.

632: If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter.

HUGO THE BOSS started from barrier 3 and was ridden by Mr J Riddell. For the Stewards Mr Neal submitted that the barrier arm came across striking the colt on the head. He showed the head-on film noting the reaction of the horse as it was struck saying it was clearly disadvantaged. Mr Riddell said while the gates opened on time the barrier came back and hit his horse on the head. The knock definitely affected him with the horse racing ungenerously from that point on eventually finishing in last place.

The only further point Mr Bary raised was that he would have expected his horse to be racing near the lead.

Reasons for Decision:

The first part of Rule 632 asks us to consider whether or not the horse was prevented from taking an effective part in the race owing to the mechanical failure of the starting stalls or was denied a fair start. The Committee is satisfied by the evidence that there was a mechanical failure. The gates are meant to open and stay open however on this occasion the gate of HUGO THE BOSS sprung back as the horses jumped. The films clearly showed HUGO THE BOSS being struck across the head and its reaction left us in no doubt it was denied a fair start.

We have a discretion as to whether to declare HUGO THE BOSS a non-starter or not. Taking into account the severity of the knock to the head it was clear to the Committee that this had a material effect on the horse’s performance.
