Following the running of Race 8, Dixon & Dunlop Captain Cook Stakes, an information was filed by Stipendiary Steward, Mr N J Goodwin, against Licensed Jockey, Mr M D Hills, alleging a breach of Rule 638 (1) (d) in that Mr Hills permitted his mount, VELOZ, to shift inwards near the 1500 metres when not clear of CULMINATE (L G Innes) which was dictated inwards onto ISTISTAR (N G Harris) who was checked and also affected in this incident was STERLING PRINCE (C E Lammas).

Mr Hills was present at the hearing of the information and he indicated that he admitted the breach which was found proved accordingly.

Rule 638 (1) (d) provides as follows:
--638 (1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
--(d) careless.

Mr Goodwin showed head-on and side-on video replays of the incident, which occurred shortly after the start of the 1600 metres event. He pointed out VELOZ, ridden by Mr Hills, which had drawn barrier 6. He also pointed out the runners drawn on the inside of VELOZ – CULMINATE (5), ISTISTAR (4) and STERLING PRINCE (3). The inside runners were racing free of interference. He pointed out Mr Hills angle his mount inwards for a better position closer to the rail but, in doing so, was not clear of CULMINATE and dictated that runner inwards. Mr Harris on ISTISTAR was forced to check out of a position that was rightfully his, in the Stewards’ opinion, and lost several lengths. STERLING PRINCE was “shifted in” as a consequence. There was no outward movement from Mr Lammas – the interference was, clearly, the result of the inward movement by Mr Hills. Mr Hills was never clear of the affected runners, Mr Goodwin alleged.

Mr Hills declined the opportunity to comment on the incident.

Mr Goodwin informed the Committee that Mr Hills had recently been sidelined for 6 months by injury. His riding record was clear of breaches in the last 12 months. The Stewards put the incident in the medium range of carelessness. Mr Hills had misjudged his inwards movement. Mr Goodwin pointed out that the Race was a Group 1 race. The resultant interference to ISTISTAR was “quite severe”. Mr Goodwin sought a suspension of not less than 6 days and a fine in the range of $600-800. He pointed out that Mr Hills on VELOZ had finished 2nd in the Race.

Mr Hills did not seek a deferment of the commencement of any term of suspension.

In determining penalty, the Committee took into account Mr Hills’ admission of the breach and his good race riding record, even allowing for the time out through injury. The Committee agreed with Mr Goodwin that the degree of carelessness was no worse than mid-range and involved an error of judgement on Mr Hills’ part. Aggravating factors were that the Race was a Group 1 race for a total stake of $200,000 and the interference suffered, in particular, by ISTISTAR.

Mr Hills’ jockey’s licence was suspended from after the close of racing on 5 December 2009 up to and including Wednesday, 16 December 2009 – effectively, 6 riding days. In addition, Mr Hills was fined the sum of $600.
