Mr Lammas admitted the breach therefore the charge was found to be proven.
Penalty:
Mr Lammas rides throughout the country and taking into acount his riding engagements over the next 7 days he is suspended from riding from the conclusion of racing on Saturday December 11th until the conclusion of racing on Friday December 17th.
Charge:
Following Race 6 Mr Lammas was charged with a breach of Rule 638(1)(d) in that passing the 250m he permitted his mount SEA A STAR to shift in when not clear of SITARA (M Coleman) crowding that runner in onto RAMPANT (M Cameron) which was steadied, this resulting in SITARA then shifting out causing GRASSE (M Du Plessis) to check.
Facts:
Mr George showed all three video angles (head, side and rear views) of the incident as it unfolded in the home straight. Mr Lammas was making a strong run to the finish out in the middle of the track when he allowed his horse to roll inwards approximately one horse width. SITARA was immediately to his inside and was crowded in onto RAMPANT. The resultant buffeting that occured saw GRASSE who was in behind these two horses receive a bad check for Mr Du Plessis.
Mr Lammas said that as his horse got to the front it got a bit lost and rolled inwards after he struck it with the whip but once he felt this happen he stopped riding and straightened up.
Submissions for Penalty:
Mr George said that Mr Lammas had been suspended only twice since January for careless riding and that this incident today was not at the high end of the scale. He said that there may have been slight movement from horses to the inside which contributed nevertheless Mr Du Plessis did receive quite a severe check as a result of Mr Lammas's initial movement inwards.The stewards' submission was for a period of suspension.
Mr Lammas asked the committee to take into account the mitigating circumstances of the incident and advised that he had a riding commitment next Saturday in a Group 3 race.
Reasons for Penalty:
In coming to a decision on penalty the committee took into account all of the submissions. We considered that two suspensions within the last 12 months for careless riding to be a very good record. As to the level of carelessness it was our opinion that this was in the mid range. Mr Lammas did not move very far off his line of running and once he realised that he had rolled in he did correct his mount as soon as he could. Unfortunately for Mr Lammas there were quite a number of horses to his inside and the consequential effect of his movement was significant, especially to Mr Du Plessis. While Mr Lammas was definitely responsible for the initial crowding we also accept that there may have been some contributory movement from other horses which made the end result more severe.
We have given credit for his admission of the breach and believe that a term of suspension of four days is an appropriate penalty under the circumstances.
