The Committee therefore declared that BOSTON STRONG BOY be declared a non-runner.
Facts:
Following the running of Race 8 (Stephanie Murray Mortgages Premier) the siren was sounded and an Information lodged with the Judicial Committee requesting a Ruling in relation to Rule 902 (1): whether BOSTON STRONG BOY was affected by the trespasser near the 100 metres.
Rule 902 (1) reads: The Judicial Committee shall have jurisdiction to hear and determine all proceedings commenced pursuant to these Rules, which are not expressly stated by any of these Rules to be within the jurisdiction of any other person or body.
Submissions for Decision:
The head, side on and rear-view films were played, and Mr Parkes explained how his horse had been affected when a person ran out onto the track near the 100m of the race.
Prior to the incident Mr Parkes was in front but believed the horse to the outside of the track (the eventual winner) had him covered. Nonetheless he still thought he had a good chance of running 2nd or 3rd until such time as the trespasser suddenly ran out in front of him. Mr Parkes immediately took a hold of his horse but was unsure which way to go. For a few strides after the incident he was slightly shocked and took a moment to start riding his horse again.
Mr Oatham said that following the incident Mr Parkes’ riding style was very different and it definitely affected his chances. He finished in 6th place.
Reasons for Decision:
The films confirmed Mr Parkes’ version of events. The interloper appeared very quickly in front of the field after jumping two or three fences from inside the public area and running to the middle of the track to face the oncoming field. Fortunately, Mr Parkes reacted quickly and instinctively in what was a very dangerous situation. As a result, his mount had its momentum affected for 8-10 strides at a vital stage of the race. While it will never be known exactly where BOSTON STRONG BOY would have finished had he not been impeded, all the evidence suggested he would have finished in a higher placing.
