Mr. G. Rogerson sought a ruling from the judicial committee under Rules 641 and 902 (2) (b) (viii) on the Judge’s decision of the dead-heat for 2nd in the Century City Wellington Cup.
The Judge’s placings were:

Rule 902 (2) (b) (viii) provides as follows:
The functions of a Judicial Committee shall be: to consider and determine the following matters in connection with racing: all matters submitted to it for judicial determination or for a ruling under these rules.
Rule 641 reads:
The Judge shall place all horses in a Race according to the order in which their noses have reached the winning post.
Mr. Rogerson, part-owner and trainer of the horse AWESOME PLANET said that following the running of the Wellington Cup he requested a copy of the photo finish. He disputed the Judge’s placings believing there was a fine margin between the declared dead-heaters in favour of his runner. He expressed this to the stipendiary steward in charge on the day, Mr. John Oatham.
--Both Mr. Oatham and Mr. Rogerson visited the Judge’s box and viewed the photo finish on the computer screen. Mr. Oatham was in agreement with the Judge’s placings but Mr. Rogerson was still adamant that AWESOME PLANET finished ahead of MANONAMISSION. He requested a ruling from the committee and the siren was sounded indicating an enquiry in the race.
--The connections of MANONAMISSION were called and owners Ms Kim Clapperton and Mr. A. Rennie attended. Also called to attend were the Judges Mr. D. Hunt, Mr. Hunt junior and Mr. Peter Sinclair the photo-finish operator.
--Mr. Rogerson showed the photo that had been printed of the finish and explained his concern. In the photo the nose of his horse was superimposed over the tail of the winner RED RULER. This made it very difficult to determine where the actual end of the nose was as it merged into the tail of the horse in front. MANONAMISSION was wider and clear of any superimposition.
--The committee agreed that the photo was not conclusive of a dead-heat and asked to be taken to the Judge’s box to see the finish on the computer screen. This allowed the image to be magnified right up to individual pixels. The added advantage of viewing the monitor was the ability to see the horses in full colour (the print-out was in black and white).
--After studying the finish the committee was satisfied that the Judge’s decision was correct and placings were allowed to stand as called.
