CHARGES:

Careless Riding

 

FACTS:

Following race 9 an information was filed pursuant to rule 638(1) (d). Mr Oatham alleged that near the 1300 metres Miss S Spratt, the rider of MUFHASA, permitted her mount to shift out when not clear of HOLD IT HARVEY forcing that rider wider on the track.

 

SUBMISSION(s):

Mr George demonstrated the video films which showed MUFHASA racing in a 2 wide position at the 1400 metre mark. Approaching the 1300 metres Miss Spratt eased MUFHASA back and shifted out into the line of HOLD IT HARVEY. Mr George submitted Miss Spratt was not the required distance clear and HOLD IT HARVEY lost its rightful line of running by being forced out and back.

Miss Spratt said MUFHASA was pulling at the time and she moved out to avoid the heels of BRAGATA who was racing directly in front of her. She admitted her mount has shifted out albeit more than she anticipated. Miss Spratt believed it was more competitive riding than carelessness.

Mr Brown said it was a group 1 race and both horses were wearing blinkers which impeded their vision. He said it was common knowledge that MUFHASA races best outside the leader and submitted it was a completive ride.

 

DECISION:

As the breach was admitted we find the charge proved.

 

SUBMISSION(s) ON PENALTY:

Mr Oatham said Miss Spratt had incurred 3 suspensions in the last 3 months. He reminded the committee it was a group 1 race but conceded Miss Spratt’s carelessness was at the lower end. He submitted a suspension of 6 – 8 days would be appropriate and asked the committee to consider imposing a fine of $250 - $500 as this was a group 1 race.

Miss Spratt said she had commitments up to and including 11 December. She submitted she rides as far south as Christchurch.

 

REASON(s):

The committee carefully considered all evidence and submissions. Mitigating factors are Miss Spratt’s admission of the breach and her good riding record. While the committee finds this breach at the low end it occurred in a group 1 race and Miss Spratt gained an advantage by moving out when insufficiently clear to race outside the leader. This resulted in HOLD IT HARVEY having its rightful line of running taken away.

 

PENALTY:
After taking all the above into account we impose a suspension on Miss Spratt from riding in races which is to start after racing on 11 December and conclude after racing on 24 December (6 days). This deferment comes pursuant to rule 1106 (2). In addition we impose a fine of $500.
