As Mr Grylls admitted the breach the charge was found proved.
Penalty:
Taking into account Mr Grylll's riding commitments and the fact that he is a national rider he is suspended from the conclusion of racing on Saturday February 5th until the conclusion of racing on Saturday February 12th. This is a 5 day suspension with the committee mindful of the fact that the last day is a premier race meeting at Te Rapa.
Charge:
Following Race 6 the Harcourts Thorndon Mile (Group 1) Mr Grylls was charged with a breach of rule 638(1)(d) in that he permitted his mount OBSESSION to shift outwards near the 400 metres when not sufficiently clear of HEZA KARMA KARZI (N Harris)which was checked.
Facts:
Mr Goodwin used the head-on video to show the field turning for home and at the 400 metre mark showed where Mr Grylls angled OBSESSION outwards looking for clear racing room. As he did so he was not sufficiently clear of HEZA KARMA KARZI who was quite severely jostled for a short distance.
Mr Grylls said that HEZA KARMA KARZI was obviously weakening while his horse (OBSESSION) was travelling much better so when he saw a gap begin to open he took it.
Submissions for Penalty:
Mr George produced Mr Gryll's riding record which showed three suspensions for careless riding in the last 12 months. He said that for a busy rider this was a very good record.
Although Mr Grylls shifted out to obtain racing room when not sufficiently clear Mr George placed this incident of careless riding in the low to medium range. This was a Group 1 race but no dividend or stakes bearing places had been affected.
Mr George said that Mr Grylls rides throughout the country and that a suspension in the vicinity of four days was an appropriate penalty.
Mr Grylls confirmed his record was correct and advised (after speaking to his riding agent) that he had commitments at Te Rapa on Saturday February 5th.

The committee took into account all of the submissions put before it. Mr Grylls was on a horse travelling well but with a tiring horse in front of him. When he saw a gap begin to open he angled out to take it but there was not quite enough room to go through without causing jostling to HEZA KARMA KARZI.
This was a Group 1 race worth $200,000 and penalties in black-type races are normally more severe than in lower stakes races. If Mr Grylls had ridden in such a way where he had "thrown caution to the wind" or had extinguished the chances of another runner then he would be facing a lengthy suspension however any penalty imposed must be representative of the offending and the degree of carelessness in this instance was deemed to be at the lower end by the committee.
The matter of a fine in addition to a suspension was discussed. Mr George said that in the circumstances (no stakes placing involved) he did not recommend a fine.
Mitigating factors for Mr Grylls were his very good record and his admission of the breach.
