As Mr Innes admitted the breach the charge was found to be proved.

Penalty:

It was explained that Te Teko scheduled for Monday January 31st was not counted as a one of the four days because riders had already been declared for that race meeting. Mr Innes was suspended from the close of racing on Monday January 31st until the close of racing on Saturday February 5th.

Charge:

Following race 5 the New Zealand Bloodstock Desert Gold Stakes (Group 3) Mr L Innes was charged with a breach of Rule 638(1)(d) in that he permitted his mount RUN TO THE BANK to shift inwards near the 150 metres when not sufficiently clear of SHEZ SINSATIONAL (O Bosson) which was crowded inwards onto SMOULDER (C Ormsby) which was checked.

Facts:

Mr Goodwin highlighted the incident using all three video angles. The head-on film showed Mr Innes racing in the middle of the track when his mount, RUN TO THE BANK, shifted inwards towards SHEZ SINSATIONAL crowding that horse onto SMOULDER who received a check. The side on film showed that Mr Innes was never clear of the horse to his inside when he shifted ground and also that he continued to ride with vigour througout.

Mr Innes, while admitting the breach, said that his horse was getting tired and that other circumstances of the race may have had some bearing on the incident. He said that DATING had come out,  Mr Bosson should probably have come down the outside on SHEZ SINSATIONAL and Jonathon Riddell had come off the rail on ANGEL DEL DINERO.

Submissions for Penalty:

Mr George said that Mr Innes had a good record when considering the number of rides that he has, incurring suspensions for careless riding in October, August and April last year.

He said the interference was in the medium range and submitted that a four day suspension was an appropriate penalty. He also informed the committee that Mr Innes was a national rider.

Mr Innes confirmed his record was correct and advised that he had no riding commitments within the next 7 days therefore any suspension could begin immediately.

Reasons for Penalty:

In coming to a decision on penalty the committee had regard to all of the submissions. We took into account Mr Innes's admission of the breach and his record. For a busy rider such as Mr Innes three suspensions in 11 months can be considered a good record.

The race carried a Group 3 status with stakes totalling $70,000. Normally a suspension for careless riding in such an event would incur a more severe penalty than one incurred in a race that did not carry black type. The consequences of interference in Group races can often be more severe with higher stakes and prestige on offer.  In this situation, however, Mr Innes did not finish in a dividend bearing position and it was accepted that his carelessness did not deny the other horses involved such a position either.

When considering the term of suspension therefore the committee began with a starting point of 5 days. This was reduced to four days when the mitigating factors (Mr Innes's record and his admission of the breach) were taken into account.
