The information alleges that P Bell the rider of CHUNKY CHIC allowed his mount to shift inward near the 850 Metre Mark when not clear of MISS MONTJEU (G Grylls) who was dictated in onto ELECTRIC HEIGHTS (K Myers) which was checked.

Mr Bell was present at the hearing and was represented by Licensed Trainer D Haworth. The rule was read and those present acknowledged they understood same, and also confirmed that Mr Bell admitted the breach.

Mr Barnsley (Assistant Stipendiary Steward) demonstrated a film of the alleged incident. Mr Haworth nor Mr Bell wished to give their interpretation of the film nor did they have any questions of Mr Barnlsey.

Mr George then gave Mr Bell's record which was that since he had gained his license 4.12.05 he had not been charged under this rule.

Neither Mr Haworth nor Mr Bell wished to make any submissions as to penalty when given the opportunity to do so.

When arriving at the penalty the Committee took into account that it was Mr Bell's first offence under this rule, also his admission of the breach. However these facts were outweighed by the fact that the film clearly showed when racing three wide and no more than one length clear, Mr Bell had let his mount come across onto Mr Gryll's mount forcing that horse onto Miss Myers horse. They were therefore of the opinion that a term of suspension was warranted and suspended Mr Bell from the conclusion of racing on the 28.10.06 until the conclusion of racing on the 7.11.06.
